
Victorian Workers Compensation Arbitration Specialist

This position plays a pivotal role in the proactive management and resolution of disputes, ensuring optimal outcomes.
In cases where disputes proceed to arbitration hearings, thorough review and evaluation of evidence is required, alongside making submissions on facts and law, including cross-examination of witnesses.
The Arbitration Dispute Resolution Specialist will be responsible for:
- Providing expert advice and reviewing evidence at Work Injury Commission (WIC) as needed, negotiating settlements, and making submissions of facts and law at arbitration hearings and conciliation conferences.
- Evaluating dispute merits, case sustainability, and determining resolution strategies while actively participating in arbitration hearings and conciliation conferences to facilitate timely dispute resolution.
- Gathering and preparing evidence for arbitration hearings and conciliation conferences, including arranging and cross-examining witnesses when necessary. Preparing and delivering well-reasoned and clear oral and written submissions.
- Engaging with relevant internal and external stakeholders regarding dispute nature and potential resolution outcomes.
- Collaborating with workers/worker representatives about dispute(s), attempting early resolution in line with WorkSafe requirements, key performance indicators, and authorisation levels.
- Staying up-to-date with relevant case law and precedents affecting claims determinations and the scheme.
To succeed in this role, you will require:
- A Bachelor of Laws or equivalent qualification (preferable).
- Background experience in Victorian workers compensation disputation and litigation processes or alternative dispute resolution.
- Excellent engagement, negotiation, conflict resolution, people, and stakeholder management skills, with an understanding of the Victorian workers compensation stakeholder environment.
- Strong knowledge of Victorian workers compensation legislation and case law, Online Claims Manual, and additional WorkSafe guidelines, processes, and procedures, Ministerial Directions, and other relevant documentation applicable to claims management and alternative dispute resolution.
- Dispute resolution experience or familiarity with legal processes, including concepts of procedural fairness and knowledge of the rules of evidence.
- Approachable communication style with excellent oral and written communication skills, previous advocacy experience.
