Position Description - Development Officer - Compliance

Purpose
This position will primarily be responsible for development enforcement, relating to the
handling of development-related complaints such as unauthorised changes of use and
unlawful/unsafe development more generally, including development that is not
consistent with Development Approvals and/or not consistent with relevant development
legislation.

The position is responsible for the on-going resolution of the complaints including Section
213 and Section 214 proceedings. The position may also entail general inspections and
compliance follow-ups of completed developments to ensure compliance with the
Development Approval and Planning Development and Infrastructure Act (PDI Act) and
associated Regulations, more generally.

The officer is expected to be able to work as part of a team and independently, with the
capacity to work under limited direction. The officer should utilise a high level of
interpersonal skills in dealing with the public and other organisations. The organisation
places a high emphasis on providing an excellent customer experience to both internal
and external customers.

Key Deliverables:

  • Resolve development enforcement matters relating to changes of use, unlawful or
- unsafe development.- process in the investigation of development matters.
  • Determine appropriate action to achieve compliance with relevant legislation, and
- undertake the required action.
  • Negotiate with applicants, architects, developers and the public to achieve the best
- possible development outcomes and with a view to resolving complaints.
  • Issue Notices, expiations, and initiate Court action pursuant to the PDI Act on an as

- needs basis.
  • Instruct and brief Council's solicitors on development matters, and represent Council
at the Environment Resources and Development Court regarding development
matters.

  • Respond to requests and complaints relating to development matters and breaches of
relevant legislation from a range of internal and external stakeholders.

  • Provide advice to other Council officers and departments on development enforcement
