About the Role

This is an exciting opportunity to join McConnell Dowell Constructors as a Commercial Manager, providing support to our operational construction projects and the Commercial team. As a key member of our team, you will be responsible for overseeing and critiquing tender submissions, managing contractual and commercial disputes, and promoting business unit training on contract administration and project management commercial tools.

Key Responsibilities
  • Tender Management: Review and critique tender submissions to identify potential risks and opportunities, and negotiate with clients to achieve acceptable contractual terms.
  • Contractual Dispute Resolution: Assist in the management of contractual disputes, coordinate with legal counsel and insurance representatives, and prepare internal management reports on dispute status.
  • Business Unit Training: Develop and implement training programs to enhance contract administration and project management skills, and ensure the Business Unit's training activities meet current and future organizational needs.
  • Contract Preparation: Assist in the preparation of subcontractor and consultant contract forms, ensuring appropriate commercial terms are incorporated.
  • Joint Venture Documentation: Prepare and develop joint venture documentation, pre-bid agreements, and MOUs as needed.
  • Contractual Advice: Provide guidance on contractual and commercial matters, including compliance with contract documents, legislation, and Australian or relevant standards.
About You

To be successful in this role, you will need:

  • Relevant tertiary qualifications.
  • Minimum of ten years' experience in project/contractual engineering.
  • Experience with various contract forms, including D&C, Construct Only, Alliance, ECI, and the NEC suite of contracts.
  • Demonstrated ability to determine the best course of action to achieve improved results within the business.
  • Strong understanding of company and individual needs, with the ability to plan and implement developmental activities to increase competency and meet future business goals.
  • Excellent conflict resolution skills, with the ability to meet challenging business objectives.
  • Ability to generate innovative solutions to day-to-day problems.
  • Experience in increasing profitability through the innovative handling of complex business and technical problems.
  • Strong teamwork and communication skills, with the ability to promote business strategy and create a dynamic atmosphere.
