Regulatory Legal Advisor Role

The Regulatory Legal team provides expert advice and support to regulatory activities, including investigations under the Work Health and Safety Act 2011 (WHS Act) and criminal prosecutions for alleged contraventions of the WHS Act.

The team supports the Regulatory Operations Group by:

  • Providing strategic guidance on evidence gathering, issuing statutory notices, and investigation procedures.
  • Assisting with the preparation of evidence in prosecution cases.
  • Collaborating closely with the Commonwealth Director of Public Prosecution and the Inspector when a prosecution is commenced.
  • Facilitating continuous improvement projects and identifying trends and capability opportunities for inspectors.

Key Responsibilities

Under limited direction, the Regulatory Legal Advisor works closely with Senior Legal Advisors in performing their roles and provides client-focused specialist legal and strategic advice and support to staff on complex legal and policy matters.

The Regulatory Legal Advisor will resolve problems and manage risk effectively, managing workload in a manner consistent with the APS Values and Code of Conduct, internal policies, and procedures.

Eligibility and Requirements

  • Admission as a legal practitioner of the High Court or the Supreme Court of an Australian State or Territory.
  • Current Practising Certificate or ability to obtain one within three months.
