Job Overview

The Regulatory Legal team delivers expert advice and support to Comcare's regulatory activities, encompassing investigations under the federal Work Health and Safety Act 2011 (WHS Act) and criminal prosecutions for alleged contraventions of the WHS Act.

The Senior Legal Adviser is responsible for providing strategic legal support to investigations, inspections, and other regulatory activity conducted under the WHS Act, as well as assisting with the conduct of prosecutions commenced under that Act.

Key Responsibilities
  • Providing in-depth legal guidance on evidence gathering, issuing statutory notices, and investigation procedures;
  • Assisting with the preparation of comprehensive briefs of evidence for prosecutions;
  • Collaborating closely with the Commonwealth Director of Public Prosecutions and Inspectors when a prosecution is commenced;
  • Facilitating continuous improvement projects and identifying trends and capability opportunities for inspectors.
Essential Skills and Qualifications
  • Mandatory qualifications: admission as a legal practitioner of the High Court or the Supreme Court of an Australian State or Territory, with five years or more post-admission experience highly regarded;
  • Current restricted practising Certificate or ability to obtain one within three months;
  • Experience in providing investigation support and conducting prosecutions in a criminal law or regulatory environment highly valued.
