This role will pro-actively assist in the management and, where possible, early resolution of disputes, ensuring positive outcomes are maximised through conciliation/arbitration.

Where disputes proceed to an arbitration hearing, the role requires the thorough review and evaluation of evidence, and to make submissions on facts and law, including cross-examination of witnesses.

This will be a full time, 8-month max term contract commencing in April, based in the Melbourne office, with flexibility to work from home.

YOUR RESPONSIBILITIES
- Reporting to the Senior Legal Specialist, attend WIC as required, provide advice on prospects, review and evaluate evidence, negotiate settlements and make submissions of facts and law at an arbitration and conciliation
- Advocacy - Prepare well-reasoned and clear oral and written submissions
- Evaluate the merits of disputes, sustainability of the decision and determine resolution strategies
- Engage with various internal and external stakeholders to achieve optimal outcomes, including in relation to claim determinations, arbitration and conciliation outcomes, and costs disputes
- Proficient knowledge of case law, precedents and policy affecting claims decisions and the scheme
- Actively participate in conciliation conference and arbitration to facilitate timely resolution of disputes by meaningfully discussing all relevant issues and attempt resolution in line with authorisation levels
- Prepare and evaluate evidence for arbitration and conciliation hearings, including arranging and cross-examining witnesses when required
- Timely and accurate provision of strategy and advice to claims management teams with decision making and liaise with external legal panel to facilitate outcomes on best possible terms for all relevant stakeholders

ABOUT YOU
- Bachelor of Laws or equivalent.
- Background in Victorian workers compensation disputation and litigation processes or in alternative dispute resolution.
- Strong engagement, negotiation, conflict resolution, people and stakeholder management skills and understanding of Victorian workers compensation stakeholder environment.
- Comprehensive understanding of Victorian workers compensation legislation and case law, the Online Claims Manual and additional WorkSafe guidelines, processes and procedures, Ministerial Directions, and other relevant documentation applicable to claims management and alternative dispute resolution.
- Understand merits review and able to discern prospects of success and sustainability of decisions.
- Competent in the use of Microsoft Office products and ability to use claims management data systems.
