Senior Investigator - Insolvency & Securities Investigations

This position is within the Regulatory Operations Group (ROG). The ROG adopts a whole-of-system approach to regulation, using data and intelligence to prioritise where we focus our resources, and using a surveillance-based approach to monitor our regulatory systems.
Within the division, the Insolvency & Securities Investigations team is responsible for investigating alleged personal insolvency offences under the Bankruptcy Act 1966 (Bankruptcy Act) and preparing briefs for prosecution. The Insolvency & Securities Investigations team also investigates alleged breaches of the Personal Properties Securities Act 2009 (PPS Act). This work directly contributes to AFSA’s reputation as a visible, modern and contemporary regulator safeguarding Australia’s strong credit system.
We are seeking applications from experienced and motivated team members for a Senior Investigator position in our Insolvency & Investigations team who be responsible for managing and progressing allocated investigations.
Key Accountabilities:
The Senior Investigators responsibilities and duties may include:
- Assessing referrals and complex enquiries for compliance with the Bankruptcy Act and/or the PPS Act, including recommending appropriate courses of action, evidence collection, exhibit handling, preparing witness statements, conducting recorded interviews and preparing briefs of evidence.
- Investigating alleged Bankruptcy Act and PPS Act offences and where appropriate, referring these cases for prosecution or civil litigation;
- Work collaboratively with the Commonwealth Director of Public Prosecutions to achieve outcomes, which includes giving evidence in court.
- Lead and manage your caseload, as well as keeping those cases up to date in our case management system.
- Assisting in the development of internal guidance and procedures to support best practice investigations.
- Respond to enquiries from a range of internal and external stakeholders throughout the region, including representatives of insolvency/trustee associations and government bodies.
- Ability to travel is an expectation of this position.

- WHS obligations, taking responsibility for own health and safety and that of others
- AFSA’s risk management framework and relevant legislation, including guiding others to identify and mitigate foreseeable risks.
Qualifications and experience
- Certificate IV in Government Investigations or its equivalent or the ability to obtain within 12 months of commencement.
- Tertiary qualifications in Law, Accounting, Commerce or relevant discipline from an Australian tertiary institution (or comparable overseas institution) or demonstrated experience gained within the Insolvency or Finance Industries are desirable.
