We are currently looking for a full-time Investigations Solicitor to join our Legal Regulation team.
About the team The Professional Standards, Legal Regulation Department carries out co-regulatory functions under delegation and overseen by the Office of the Legal Services Commissioner regarding lawyers in NSW.
The Investigations Team is responsible for investigating complaints about lawyers' conduct and suitability issues under Chapters 3 and 5 of the Legal Profession Uniform Law (NSW).
Investigations Solicitors within this team are responsible for carrying out the Department's statutory functions under the Uniform Law.
What you'll be doing Conduct investigations of complaints about lawyers expeditiously under Chapter 5, ensuring fairness and impartiality in accordance with the Uniform Law.
Examine suitability issues related to a lawyer's fitness to hold a practising certificate under Chapter 3 of the Uniform Law.
Review and analyse trust investigation reports and make considered recommendations to the Director, Legal Regulation, and to the Law Society of NSW Council.
Manage a variety of complex cases, including complaints, suitability issues, and trust investigations.
Identify key conduct issues, critically analyse evidence, and determine additional evidence requirements.
Examine evidence, draft statutory notices, conduct legal research, and prepare reports with recommendations for the Professional Conduct Committee.
Ensure compliance with statutory requirements under the Uniform Law.
Draft clear and well-researched memoranda on suitability issues for the Council.
Liaise with complainants, solicitors, the Professional Conduct Committee, the Council, the NSW Legal Services Commissioner, and other stakeholders.
Contribute to departmental policy and educational initiatives, including legislative and legal development.
Promote high ethical standards and practice excellence within the legal profession through active participation in departmental goals.
About you Admitted to the Roll of Lawyers and holding or eligible for a practising certificate.
At least 3 years of post-qualification experience.
Experience in investigations, regulation, or administrative law is desirable.
Knowledge of the Legal Profession Uniform Law (NSW) and related legislation.
Understanding of solicitor's trust accounting practices.
Ability to communicate clearly and concisely in writing.
Strong planning and organisational skills, with the ability to support others.
Effective presentation and structuring of information.
Proficiency with Microsoft Office and other relevant computer applications.
Goal-oriented with a willingness to set and achieve objectives.
Professional behaviour, understanding of organisational culture, and appropriate conduct.
Analytical skills to interpret information and make sound judgments.
Honest, trustworthy, and fair in dealings, with transparency about conflicts of interest.
