What does the right person look like?

We are currently searching for a Solicitor – Commercial and Advisory that will assist the Commercial team in Sydney with a focus on commercial lending files, support for residential and SMSF Mortgage transactions and general property related advisory.

Responsibilities include a range of tasks predominantly for end-of-end management commercial matters, from document preparation through to archiving of matters post settlement. For the right candidate, the role will be tailored to leverage your ability to provide thought leadership across a small professional services legal team supporting mortgage transactions.

Responsibilities Include:

• Receiving and reviewing instructions from lender clients both manually and electronically and preparing/generating specific client loan and mortgage documents for Commercial loans, including issue of electronic documents and or review of documents prepared by other members of the team.
• Review of files including trusts, leases, and ASIC/PPSR documents etc.
• Research and advice of specific file issues from a legislative perspective or otherwise when required.
• Ensuring that loan documents are completed and executed correctly and supporting documentation provided – including the review of any ratifications of the Trust Deeds or ancillary Trust Deed documentation required.
• Confirming lender client requirements are met and special conditions of the loan are satisfied.
• Organising files for settlement and preparing for lender client certification, ensuring transactional and legislative requirements are met.
• Processing and creating commercial mortgage settlement files in both paper and PEXA environments and registration on the Personal Property Securities Register (PPSR).
• Archiving of files post settlement.
• Preparation of Complex documentation (Change of Name documentation for all Jurisdictions).
• Research and advice of specific file issues from a legislative perspective or otherwise when required, relating to Residential, SMSF and Commercial lending.
• Identification of quality and capability issues or continuous improvement opportunities relating to advice tickets; and
• Championing the delivery of training and coaching to uplift the legal professional capability across Operations, working with People and Culture and other Operations leaders.

Skills and experience

• Knowledge of state property laws, commercial lending procedures, trust law general knowledge and PPSR requirements.
• Strong attention to detail.
• Ability to work under pressure and manage competing deadlines.
• Ultimate Team Player.
• Previous experience with Self-Managed Super Fund Lending (Desirable but not essential).

What do I need?

• A Bachelor of Law or equivalent with a current practising certificate.
• Minimum of 2-5 years' experience in the legal and/or banking & financial services industry with exposure to commercial lending.
