Commercial Manager

**Role Summary**:
The Commercial Manager is a fulltime role based in Sydney and will work directly with the Maas Civil and Maas Plant Hire Leadership Team.
The Commercial Manager will oversee project work programs, ensuring the implementation of the commercial framework and procedures whilst monitoring performance against key performance indicators.

**Key Responsibilities**
- Active participation in the senior management / leadership team of the Civil Construction & Hire segment.
- Identify and implement opportunities for continuous improvement through collaboration across Maas Civil
- Oversee the development, implementation and management of commercial strategies and contract management frameworks that are required for the transition from procurement to delivery of the contract while ensuring that these arrangements are consistent with the overall commercial management framework and align with the other contract work packages.
- Participate in commercial and contract negotiations in relation to the relevant contract work packages, ensuring that arrangements are in place to have them deliver the levels of service, performance and innovation expected from the project contracts under acceptable terms and cost.
- Foster a culture based on good governance, commitment to excellence and a high standard of professional ethics ensuring that any interaction with the delivery team operates in an environment based on high transparency, open communication, consultation and trust, through developing and maintaining a high performing, cohesive, collaborative, commercially aware, astute and delivery focused team
- Provide ad hoc advice to the General Manager - Maas Civil and Managing Director in relation to commercial issues.
- Manage contract correspondence in accordance with the requirements of the relevant contract and as requested by the Maas Civil General Manager
- Analyse and advise on commercial issues as they arise in relation to the contract.
- Prepare internal reporting and briefing material regarding commercial issues and claims;
- Provide strategic, operational, commercial and contract management advice to the project delivery team, subordinates and any other affected stakeholders
- Implement project contract management framework and dispute resolution requirements that comply with Maas Group policies and procedures and align with industry best practice
- Oversee the delivery of projects as directed and participate in post implementation reviews to ensure benefits realisation and to understand lessons to be learned
- Provide specialist advice on commercial matters, providing assurance to ensure consistency of project tender documentation and leading the commercial negotiations and evaluation of tenders
- Supervision and management of the activities of specialist advisors by monitoring progress and performance outcomes for contract management
- Working in an environment of constantly competing priorities and managing these priorities to enable completion of projects while delivering day to day tasks in the required timeframes

**Accountabilities**
- Provide effective commercial oversight and appraisal of project progress, including key issues, variations, claims, disputes, trends, risks and their allocation, opportunities and other material commercial issues or matters
- Ensure the achievement of commercial contract management outcomes in line with contract objectives and Maas Group requirements.
- Ensure the commercial elements of contracts and contractor relationships are conducted in accordance with commercial contracting principles, risk allocations, industry best practice and relevant contract terms
- Ensure commercial management is conducted in accordance with Maas Group’s Delivery Strategy, Commercial Management Plan, Contract Management Plan, specific Contract Administration Plans and other relevant commercial processes and procedures.
- Provide regular, timely and accurate management level commercial and contract management reporting
- Ensuring effective implementation of appropriate contracts management and administration systems, processes and registers to ensure commercial information remains accurate, up to date and confidential
- Ensure compliance with a high standard of probity and ethical values within the Commercial function, Project delivery team and with process users and action any instances of non-compliance through to a successful conclusion
