We are seeking a Commercially minded In-House Legal Counsel to join our dynamic team at Burger Urge. Reporting to the Head of Development, this role will involve providing proactive legal advice across the business, with a focus on franchising, property and leasing, corporate operations, and compliance. You will play a key role in safeguarding the company's brand, assets, and legal standing, ensuring we operate in full compliance with relevant laws and regulations, and supporting business transactions and growth.
Key Responsibilities:Franchising & Commercial Law
- Draft, review, and negotiate franchise agreements, disclosure documents, and renewals.
- Oversee franchise recruitment, sales, renewals, and terminations.
- Ensure compliance with the Franchising Code of Conduct and Australian Consumer Law.
- Support Franchise Development and Operations teams in implementing franchise documentation.
- Review and negotiate lease agreements for both company-owned and franchised locations.
- Liaise with landlords and agents to safeguard leasing interests.
- Provide advice on lease compliance, notices, and dispute resolution.
- Stay informed on legislative changes affecting the business and ensure company policies are compliant.
- Manage company trademarks, intellectual property, and licensing matters.
- Oversee preparation of NDAs, supplier agreements, and contractor arrangements.
- Advise and manage disputes involving franchisees, suppliers, employees, or landlords.
- Identify legal risks and propose mitigation strategies.
- Coordinate with external legal counsel as necessary and ensure cost-effective management.
- Act as a trusted advisor to the executive team on business decisions, risk exposure, and structuring.
- Contribute to the development of corporate strategies and policies from a legal perspective.
- Deliver training sessions on legal and compliance matters for staff and franchisees.
Essential:
- Bachelor of Laws (LLB) and a current practicing certificate (or eligibility for one) in Australia.
- Minimum of 5 years' post-admission experience in commercial, franchising, or property law.
- Strong understanding of the Franchising Code of Conduct and Australian Consumer Law.
- Exceptional skills in drafting, negotiation, and providing commercial advice.
- Strong communication and stakeholder management abilities.
Desirable:
- Experience working in-house in a franchised or hospitality/retail business.
- Exposure to intellectual property and brand protection.
- Pragmatic, business-oriented approach to legal problem-solving.
