Primary objective

The NT WorkSafe Prosecutor is responsible for the delivery of prosecution services on behalf of the Work Health Authority,

Electrical Safety Regulator and delegate of the Competent Authority of Dangerous Goods. This role is part of a small, high-

performing team responsible for conducting investigations into breaches of legislation administered by NT WorkSafe.

Context Statement

The position is a primary source of high-quality legal advice on less complex prosecution issues. Advice may be sought from more

senior Prosecutors as required.

Key duties and responsibilities

1. Carriage and conduct of pleas, committal proceedings and contested summary prosecutions and instruct in Supreme Court

trials.

2. Liaise with the judiciary, defence counsel, and other legal representatives in the conduct and management of proceedings.

3. Provide legal advice to the Director, the Regulator and ad hoc advice to Investigators about charges based on current evidence

available and collaborate to evaluate and prepare briefs of evidence and make recommendations.

4. Work closely with investigators to ensure regulatory objectives are met through effective enforcement action and in line with

the Regulators compliance pyramid.

5. Work closely with the NT WorkSafe Support Officer to support and liaise with victims and witnesses throughout the court

process.

6. Maintain current and comprehensive knowledge of relevant legislation, criminal procedure, evidentiary standards, and court

practices.

7. Maintain a legal practice in accordance with the office's practices and procedures (e.g. maintain case files and notes etc in

accordance with accepted legal practice, operate in a professional manner, ensure on time appearances in court etc).

Selection criteria

Essential

1. Admission as an Australian legal practitioner and eligibility to hold a practising certificate in the Northern Territory.

2. Demonstrated experience in criminal law, evidence, practice, procedure and guidelines of the Director of Public Prosecutions

NT.

3. Proven ability in the conduct of contested summary hearings, committals and appeals with the capacity to instruct on criminal

trials before a jury as well as sentencing hearings in both Local Court and the Supreme Court.

  1. Proven ability to liaise and negotiate effectively with defence representatives to ensure timely disclosure, identification of

matters in issues, identification of pleas and the appropriate early resolution of matters and build effective working relationships

with legal counsel, investigators, court staff, and other stakeholders.

  1. Proven capacity to manage multiple priorities, meet deadlines, and perform effectively under pressure in a dynamic regulatory

environment and working collaboratively within a small team.

  1. Demonstrated analytical and legal research skills with the ability to interpret and apply legislation, case law and legal policy.

Desirable

1. Experience in regulatory enforcement, particularly within a safety or compliance environment.

2. Familiarity with electronic case management systems and digital brief preparation.
