**Division Responsibilities**

The Legal and Assurance Division includes the Department of Health and Aged Care’s

internal legal practice delivering legal services across the wide spectrum of the

Department’s activities. The Department’s lawyers work in an exciting, dynamic and

intellectually challenging environment providing legal services including in areas of law such

as administrative law, commercial law, corporate governance, employment, and

information law.

Legal and Assurance Division comprises the:

- Advice and Legislation Branch;
- Corporate, Commercial and Litigation Branch; and
- Corporate Assurance Branch

The legal branches are the first point of contact for Departmental staff requiring legal advice

and assistance. These branches are responsible for delivering a range of high quality, client

focused legal services to Portfolio Ministers, the Executive and other senior officers of the

Department on a broad range of complex legislative, program and policy issues affecting the

portfolio. The legal branches strategically manage legal risks to enable the Department to

deliver its strategic and corporate priorities and ultimately, its vision.

**Branch Responsibilities**

The Corporate, Commercial and Litigation Branch provides strategic legal advice to the

Secretary, the Executive and the line areas of the Department, on matters of litigation,

dispute resolution, support for response to COVID-19 including the vaccine rollout,

commercial law, privacy, data sharing, employment law and corporate governance

(including statutory appointments). The branch comprises the following sections:

- Commercial Law
- Governance, Employment and COVID-19 Legal
- Legal Policy and Practice Management
- Litigation
- Privacy Law

**Section Responsibilities**

**Governance, Employment and COVID-19**

The Governance, Employment and COVID-19 Legal team is responsible for the provision of

legal advice and support for the department's response to the COVID-19 pandemic. This has

expanded to now include supporting the Vaccines Taskforce, which is currently contracting

with a wide range of vaccine providers, distributors and service providers. It also advises on

a range of employment matters and provides legal advice to the department on responding

to Parliament, non-employment discrimination complaints, non-employment whistle
- blower complaints, governance of portfolio statutory committees and other governance

matters.

**Litigation**

The Litigation Section manages the majority of the Department’s litigation caseload. This

includes matters in the Administrative Appeals Tribunal, State and Territory courts, the

Federal Court and the High Court. The Section also manages requests for Departmental

assistance in relation to external investigations, including inquests and coronial inquiries,

and compliance with subpoenas and notices for production of Departmental records, as well

compensation mechanisms.

**Key Responsibilities**

Examples of the work that may be undertaken at this level include:

- Leading and managing legal staff and building team capacity through coaching and

performance feedback as well as encouraging career development.
- Contributing to building the capacity and culture of the branch.
- Providing accurate and specialised legal advice including anticipating problems and

contributing to issues management in consultation with supervisors.
- Advising on general regulatory and compliance matters under Commonwealth

legislation.

frameworks, government decision-making proc
