SYNOPSIS:
**About the team**
The Compliance Branch is one of four branches of the Foreign Investment Division (the Division). The Division administers Australia’s foreign investment laws as outlined in the Foreign Acquisitions and Takeovers Act 1975 (the Act) and provides advice to the Government on foreign investment policy. The Division closely engages with counterparts across Commonwealth, State and Territory governments and has significant engagement with the private sector. It supports the Foreign Investment Review Board (FIRB) which is a non statutory body that advises the Treasurer and Government on foreign investment matters.
The Compliance Branch is responsible for monitoring and enforcing compliance with Australia’s foreign investment laws. Its role is to promote confidence in, and provide assurance of compliance with the foreign investment framework to the Australian Government and the community. The Compliance Branch does this through a range of activities which include:
- educating foreign investors and their advisers on their obligations under the foreign investment legislation.
- assessing and assuring compliance through proactive investigations and other forms of compliance assessment
- undertaking enforcement action to address non-compliance and where appropriate, enforcing compliance through penalties and sanctions.
**About the Roles**
We are looking for qualified and experienced regulatory professionals to lead teams in the Division’s Compliance branch.
There are two positions available to lead teams who investigate compliance with foreign investment laws in various ways. This includes investigating and auditing compliance with conditions imposed on investment approvals and obligations to notify certain foreign investments.
**Key duties**
- Operational and strategic leadership: lead and manage investigations of foreign investment compliance, in line with Commonwealth legislation and best practice standards. This includes to:
- Undertake proactive and reactive compliance activities to assess and detect non-compliance
- Leadership & Team Management: lead, mentor, and motivate diverse teams, including to build capability develop a team to perform at their best and deliver outcomes.
- Stakeholder Engagement: Develop and manage multiple relationships across Treasury and with external agencies to advance Treasury’s foreign investment regulation and enforcement outcomes.
- Advisory & Strategic Contributions: Provide timely advice to senior executives, Ministers, and key stakeholders, and contribute to broader Treasury initiatives where needed.
To be successful in this role, you will demonstrate the following experience, skills and attributes:
- Proven ability to lead teams to investigate complex commercial matters within deadlines, including in high pressure environments.
- Qualifications in law, accounting, economics and/or finance or extensive compliance and enforcement experience.
- Ability to hold or obtain a minimum Negative Vetting Level 1 national security clearance.
- Excellent interpersonal, and oral and written communications skills.
- Proven experience with information collection and methodologies to support complex investigations and audits.
- The exercise of sound judgement, leadership and support to others; and positivity and resilience to achieve objectives.
