SYNOPSIS:
The Compliance Branch is responsible for monitoring and enforcing compliance with Australia’s foreign investment laws. Its role is to promote confidence in, and provide assurance of compliance with the foreign investment framework to the Australian Government and the community.
**The Compliance Branch does this through a range of activities which include**:
- educating foreign investors and their advisers on their obligations under the foreign investment legislation
- assessing and assuring compliance through proactive investigations and other forms of compliance assessment
- undertaking enforcement action to address non-compliance and where appropriate, enforcing compliance through penalties and sanctions.
**About the role**:
- undertaking proactive and responsive compliance activities to assess compliance with Australia’s foreign investment laws and prevent and detect non-compliance
- investigating potential non-compliance with Australia’s foreign investment laws and/or
- assessing compliance reports for triage purposes, analyse data to identify compliance trends
- developing internal guidance and procedures to support best practice compliance operations.
Working with a high degree of independence, EL1 Assistant Directors will:
- manage concurrent compliance tasks, projects or investigations, including complex cases
- investigate and deliver enforcement outcomes, including to analyse information and data, plan and carry out investigations, gather evidence, legal analysis and other enforcement-related processes
- use analytical capability and professional judgement to evaluate compliance and recommend effective responses
- make regulatory risk assessments to identify priorities for compliance operational activity and evaluating outcomes of those compliance activities
- develop and implement policies, procedures and systems to support the lawful and appropriate exercise of compliance and enforcement powers
- manage various business or process development processes, including a compliance case database and reporting processes
- supervise and develop the performance of APS-level team members and support the team’s EL2 director in shepherding the performance of the team.
**Desirable Qualifications / Experience**:
- experience carrying out investigations or evidence-based assessments
- excellent interpersonal, and oral and written communications skills including the ability to liaise and engage with stakeholders at all levels
- ability to develop strong relationships with stakeholders; and collaborate and reconcile alternative positions to achieve timely and robust outcomes
- critical thinking skills to identify issues and potential solutions
- demonstrated ability to exercise strong attention to detail in analysis and written and oral communication
- organisational skills and the ability to manage competing priorities
- sound judgment and resilience to achieve objectives in challenging, fast-paced environments
- ability to work independently and use initiative to achieve desired outcomes
- qualifications in law, accounting, commerce and/or finance are highly desirable but not essential.
The successful applicants are required to have a minimum Negative Vetting 1 (NV1) security clearance or the ability to obtain and maintain one.
