**Who is the National Heavy Vehicle Regulator?**
The National Heavy Vehicle Regulator (NHVR) commenced operations in 2013 as a national entity responsible for
regulating all vehicles in Australia over 4.5 tonnes gross vehicle mass. Located in Brisbane, the NHVR minimises the
compliance burden on the heavy vehicle transport industry, reduces duplication and inconsistencies across state and
territory borders, and ultimately for the heavy vehicle business with government in Australia.

Position Description | Prosecutor

The The Statutory Compliance Division ensures compliance with regulatory policy, strategy and standards thought
investigation and prosecution of significant non-compliance and providing intelligence thoughout NHVR.
**Primary Objectives**
Support the prosecutions team to represent the NHVR in proceedings for offences against the Heavy Vehicle National
Law and work closely with investigators, on road compliance and enforcement officers, enforcement partner agencies
(including police) and legal representatives to ensure the timely and efficient conduct of proceedings.
**Key Responsibilities/Accountabilities**
- Preparing for matters listed in Courts of Summary Jurisdiction of various States and Territories of Australia, having

due regard to all evidentiary requirements. Appear in the Courts of Summary jurisdiction and conduct summary
and District Court hearings, as required.
- Research, analyse and make determinations on briefs of evidence and court elected expiation notices relating to

breaches of the Heavy Vehicle National Law, while ensuring that legislative and policy considerations are
appropriately applied.
- Assess the sufficiency of evidence contained in briefs and identify the correct charges to be preferred in accordance

with the Prosecution Policy of the NHVR.
- Draft documents, such as information’s and summonses in relation to breaches of the Heavy Vehicle National Law

and Regulations, while ensuring that legislative and policy considerations are applied.
- Develop and maintain an active working knowledge of legal constraints and precedents relating to matters of law

which could influence proceedings for breaches of the Heavy Vehicle National Law and Regulations.
- Work effectively, either individually or as part of a team, with an emphasis on meeting deadlines within quality, cost

and time constraints.
- Provide sound options or recommendations to internal and external stakeholders, and assist in the development of

business practices, policy and legislation.

- Actively seek and participate in personal development as well as offer support and guidance to fellow team

members.
- Consult, liaise and maintain effective relationships with internal and external stakeholders.
