About Collections Transformation and Strategic Priorities
The Collections Transformation and Strategic Priorities program is one of three programs
in the AIATSIS Collections Services Group. The other programs are Collections
Development and Management and Collection Care, Control, Preservation and
Digitisation.

The Rights Management Unit is one of three units in the Collections Transformation and
Strategic Priorities program, others being Collections Transformation, and Strategic
Priorities.

The Rights Management Unit is responsible for ensuring appropriate access and use of
materials held in the AIATSIS collection from both copyright and Indigenous Cultural and
Intellectual Property (ICIP) perspectives.

The Unit closely works with other units and programs in the Collections Services Group
as well as the Collection Access and Family History program.

About the Role
There is currently one Rights Legal Officer position available in the Rights Management
Unit. The position is a key operational position within the small Rights Management Unit
which otherwise consists of Rights Manager, Rights Project Manager, and one Senior
Rights Officer. AIATSIS is seeking to fill the vacant position with a person with legal
qualifications and experience, while the existing Senior Rights Officer holds a well
- developed understanding of ICIP.

The salary range of APS level 6 positions at AIATSIS is $77,912 - $88,620. Salary is
experience.

The key responsibilities of the Rights Legal Officer include**:
- providing legal analysis and advice in relation to intellectual property law as

applied to the AIATSIS Collection, including copyright law, contract law, archives
law and other guiding legislation
- drafting and reviewing contracts (e.g. deeds of gift and copyright deeds)
- reviewing external legal advice and providing advice on its implementation
- developing policies, guidelines, information sheets and procedures in relation to

access and use of collection materials, copyright and other relevant legislation,
and ICIP
- reviewing access and use conditions applied to collection materials and

discussing amendments to the conditions with depositors and donors

- engaging with community members and discussing access and use of collection

materials with them

- researching rights in materials held in the collection and assisting the collection

staff to ensure appropriate rights information is gathered for the management of
access to and use of collection materials

- undertaking or assisting copyright and community clearances for AIATSIS

exhibitions and publications

- providing or arranging training for AIATSIS staff on rights requirements.***

This position reports to the Rights Manager.

This position will be filled using the Affirmative Measure provision, which allows for the
targeted recruitment of Indigenous Australians into the Australian Public Service. The
vacancy is only open to Aboriginal and/or Torres Strait Islander people. The filling of this
employment opportunity is intended to constitute an Affirmative Measure under section
8(1) of the _Racial Discrimination Act 1975_.
- at least two-years post admission experience inclusive of intellectual property

law, including copyright law
- understanding of or capacity to develop expertise in Indigenous Cultural and

Intellectual Property (ICIP)
- understanding of the challenges posed by ICIP Rights and concerns Indigenous

peoples may have about Indigenous cultural heritage material being made
available for access and use
- strong interpersonal skills, including strong oral and written communication skills

with diverse internal and external stakeholders on complex matters
- strong time management and organisational skills, with a demonstrated ability to

manage changing priorities and deliver outputs.
- post admission experience working in contract law
- proficiency in developing policies and procedures
- understanding of or experience with libraries and archives, maintaining records
- and/or working with records and databases- experience developing and/or delivering legal education.

the outcomes the agency is responsible for delivering
- understands the impact of attitudes, beliefs and past experiences of Aboriginal

and Torres Strait Islander peoples in the engagement and consultation process

interest in the community’s specific issues and opportunities.
