
Local Government Tribunal Member

The Councillor Conduct Tribunal is a key component in reducing instances of inappropriate conduct, misconduct, and corrupt conduct within local governments. It comprises a President and a pool of casual members who work together to hear cases and make decisions.
Responsibilities of a Casual Member:
- Conducting hearings in accordance with Chapter 7, Part 1 of the Act, observing natural justice and acting quickly and informally as is consistent with a fair and proper consideration of the issues raised in the hearing.
- Reviewing and analysing evidence.
- Exercising statutory functions of a Tribunal member.
- Ensuring that legal, ethical, and procedurally appropriate decisions are made with impartiality and independence.
- Preparing written misconduct decisions and reasons.
- Maintaining a comprehensive knowledge of legislation relevant to matters before the Tribunal.
- Complying with protocols, processes, and procedures established by the President.
- Advising the President of availability to sit on an allocated misconduct hearing in a timely manner.
- Liaising with other Tribunal members about the hearing, including but not limited to availability, procedural issues, and writing the decision and summaries.
- Acting as Chair in a misconduct hearing where agreed upon.
- Investigating alleged inappropriate conduct, drafting investigation reports, and making recommendations to the local government.
Eligibility Criteria:
- Possess extensive knowledge of and experience in local government, investigations, law, public administration, or public sector ethics.
- Section 150DO of the Act outlines factors that disqualify a person from holding the office of casual member, including being a councillor, employee of a local government, contractor of a local government, or having a conviction for an indictable offence.
Remuneration:
Casual members will receive sessional/meeting fees of $400 for four hours or less and be reimbursed for reasonable out-of-pocket expenses, including domestic travel, accommodation costs, motor vehicle allowances, and meals.
