About the Role

The ClearCompany is seeking a highly skilled and experienced Senior Litigation Manager to join our team. As a key member of our Litigation Team, you will be responsible for leading and managing a professional legal team that prepares and conducts complex litigation and provides legal advice on complicated, controversial, and politically sensitive prosecutions and civil litigation under environmental laws administered by the EPA and represent the agency in courts and tribunals.

Key Responsibilities
  • Manage, supervise, prepare, and conduct complex, controversial, and/or politically sensitive prosecutions and civil litigation for and on behalf of the EPA. Defend the EPA's administration of environmental laws to maximize positive outcomes for the EPA and the Minister.
  • Contribute to the development of strategic plans and programs that are commensurate with government and corporate strategies and priorities.
  • Plan, set, and monitor priorities on a task and project basis, to address emerging issues within its ambit, and ensure staff achieve defined outcomes and operational and strategic aims.
  • Assist with the performance management and development of staff so that all resources are matched to program priorities and the capacity for proactivity is maintained at optimum level.
  • Brief the EPA's Environmental Counsel and barristers representing the EPA and maximize the environmental and strategic outcomes of litigation while minimizing the risk of cost orders against the EPA.
  • Provide independent legal and policy advice to key stakeholders on complex litigation issues to ensure the effective resolution of legal issues.
  • Develop and conduct legal and investigative education seminars and training programs to promote and achieve environmental compliance through successful civil and criminal law enforcement.
Requirements
  • Admitted or immediately eligible to hold a practicing certificate in NSW.
  • Considerable experience and well-developed skills in conducting high-level litigation.
  • Extensive knowledge of the legislation administered by the EPA and of criminal and civil enforcement of those laws within NSW.
  • Knowledge of environmental principles and practices and exposure to the complexity of the environmental debate.
  • Experience in the provision of complex legal advice at a senior level.
