About the Role / Are you up for the challenge? Assist in the development of commercial strategies, undertake high level contract and tender reviews and provide authoritative advice to senior management on matters relating to commercial opportunities and risks associated with multiple projects within one or more regions of the Business Unit to ensure sustainable financial and operational success of the BU.

What you will do

  • General — Assist the General Manager of Commercial and Risk develop commercial strategies, policies and procedures; assist in developing and deploying training programs to ensure commercial acumen at all levels of the BU; advise senior management on legislative changes likely to impact commercial policies or existing contractual arrangements; provide regular management reports against key measures and indicators; perform all duties in accordance with John Holland policies, processes, systems and procedures.
  • Pre Contract — Assist bid teams with commercial strategies, review Tender contractual provisions and prepare the Contract Risk Assessment; review terms, conditions and risks of proposed client novated consultants and/or subcontractors; ensure TSA/CSA, Subcontract and Supply documents are prepared as required and advise on appropriate models; ensure contractual qualifications align with corporate guidelines; respond to clients' commercial/contractual requirements pre and post tender, including negotiation of Head Contract terms and conditions; ensure Head Contract contains correct information prior to signing (including sign-off from Pre Contracts staff for technical components).
  • Legal Support — Provide/obtain independent legal advice and recommendations to the Building Regional business to ensure compliant commercial arrangements and risk management, referencing Corporate Limits of Liability Guidelines and applicable legislation.
  • Post Contract — Support Project Commercial Managers in Rights and Obligations Summary at project launch; conduct site commercial audits for conformance with good contract administration, JH procedures, contracts, legislation; review terms of proforma subcontract/consultancy/supply agreements for compliance; advise site teams on contractual issues (subcontract conditions, SOPA, EOT, scope, variations, claims, defects); manage adjudication claims and subcontractor insolvencies; mentor site commercial staff; track competency and training; support/management of contractual & insurance claims; provide updates to legal counsel; advise project directors/managers on contract/risk management methodology; review project contract variations and delays; undertake post-contract completion reviews; ensure accurate forecasting of costs and revenue and maximize project profit; lead risk workshops where required for regional New Contracts and Operations.
  • What we are looking forQualifications: Bachelor degree or equivalent in Law, Commerce, Accounting, Quantity Surveying, Construction Management, Engineering, Business or related disciplines; Post graduate qualifications (graduate certificate/diploma) in related fields.
  • Experience — 15+ years in commercial and contract administration on construction/engineering projects; advanced skills in project commercial management, contract administration, and project management; strong negotiation skills and EQ with people; ability to interpret and draft commercial clauses.
