About the Litigation & Corporate team

You will join a dynamic team of legal officers to guide the Department of Education through complex legal frameworks, working across a broad range of stakeholders and areas of law. We provide advice to schools and business units, draft research-based legal advice, negotiate with defendants and claimant solicitors, provide representation in tribunal matters, court hearings and mediations, and prepare a wide range of legal documents. You will find we have a good balance of in-house direct legal work and instructions to external legal providers.

About the work areas of the  role in employment law

The employment work stream is part of the Litigation & Corporate team and conducts the full suite of general employment law matters including unfair dismissal claims in the Industrial Relation Commission, providing advice and management of general human resources matters including those relating to recruitment and termination, injured workers, payment claims, and policy issues. The employment team also works closely with key stakeholders including the Health & Safety Directorate, Employee Relations and Professional Ethics and Standards on the management of employee related matters generally. You will also be engaged on Department wide projects and assist the Principal Legal Officer with the development of effective strategies for legal reform across the Department and cluster agencies.

About the role

The Legal Officer Grade 3/4 provides high-level litigation and/or legal advice, briefings and correspondence in areas of law relevant to the NSW Department of Education. The department is a dynamic organisation that aims to be Australia’s best education system and one of the finest in the world.

Key accountabilities include:

·providing high-level legal services and advice

·interpreting, analysing and preparing complex legal documents

·representing the department before courts and tribunals, and in contract and settlement negotiations

·providing high-level legal advice and recommendations on the development and implementation of legal standards and practices, strategies, systems, procedures and processes for the practice area

·supporting the practice area team in delivering legal education and training programs

·helping to collect and analyse legal data to deliver reports that inform and improve the department’s operations.

Qualifications, experience and knowledge for the employment law role

Your professional credentials, experience and expertise include:

·legal qualifications and a current NSW practising certificate

·experience as a solicitor practicing in the area of employment law or similar

·knowledge and experience in the areas of law that impact the department

·the ability to provide quality independent legal advice and explain legal issues

·complementary capabilities in statutory interpretation, legal research, legal drafting, litigation, dispute resolution and advocacy

·Working with Children Check clearance for paid employment, or a willingness to apply for clearance

·knowledge of and a commitment to the department’s Aboriginal education policies 

·demonstrated understanding of and commitment to the value of public education.
