The Department of Government Services (DGS) was established on 1 January 2023 to improve everyone's experience of doing business and interacting with the Victorian government. The Office of the General Counsel (OGC) is part of DGS' Digital Transformation Group. OGC navigates legal and policy challenges with technically excellent legal advice and strategic solutions. OGC was recently announced as a finalist in the Australian Law Awards, in the category 'In-house Team of the Year'.

**About the role**

The purpose of the role is to manage complex, sensitive and strategic litigation and provide authoritative and timely advice on complex and sensitive public law issues. Most litigation matters involve representation of the Secretary of DGS in WWC Check and NDIS Worker Screening matters. Other areas of litigation the role will manage includes births, deaths and marriages, local government, freedom of information and other general litigation matters.

The position provides expert legal advice in relation to legislation that DGS administers including the _Worker Screening Act 2020_, the _Births, Deaths and Marriages Registration Act 1996_, the _Local Government Act 2020_ and others. The position operates within a particularly sensitive political and community perceptions environment.

To be considered for the role, you must be able to demonstrate:
**Technical expertise**
- Experience analysing issues and providing clear and comprehensive legal advice in relation to public law matters such as administrative law, authorisations and delegations, constitutional law, human rights and equal opportunity, freedom of information, public inquiries or statutory interpretation.
- Experience managing complex litigation, including developing strategies for managing complex legal proceedings and manaing key stakeholder interests.

**Mandatory requirements**
- You must be admitted to practice as an Australian lawyer and eligible to hold a Victorian practising certificate.

**Key accountabilities**
- Works independently on highly complex cases and sensitive public law and disputes matters relating to DGS, including merits review matters at the Victorian Civil and Administrative Tribunal and appeals to the Supreme Court of Victoria. This will include some appearance work.
- Formulate strategies to deal with highly sensitive and complex legal matters and provide authoritative advice on complex public law and disputes legal issues with outstanding statutory interpretation skills.
- Identify and respond to new and emerging legal issues and deal with more complex or sensitive matters within the field of expertise.
- Provides authoritative written and oral advice on complex and challenging matters to stakeholders.
- Develops briefs, advices and other written documents on complex issues that provide definitive options.
- Support and work collaboratively with the OGC and DGS leadership team and contribute to the strategic planning and decision-making processes of DGS as required
