**The Role**
Defence Legal (DL) is a national organisation which provides legal advice and other legal support services to Defence. We draw upon the professional talent of our people to pursue excellence in support of Defence operations, command, management and administration. As part of the General Counsel-Defence Branch, this position provides legal support to Defence groups and decision makers on Employment Law matters, the Public Governance, Performance and Accountability Act 2013 (PGPA Act) and discretionary financial mechanisms.
Our team provides complex and sensitive legal advice to assist Defence to manage a diverse workforce, ensure compliance with the Commonwealth Financial Framework and to resolve financial claims against the Commonwealth. Working as a member of the team, the day to day tasks undertaken by the role include:
- Providing legal advice to internal Defence clients, drafting and reviewing documents on matters relating to APS Employment, ADF Service and Contractor Engagement.
- Providing legal advice to internal Defence clients, drafting and reviewing documents on matters relating to the PGPA Act, including grants.
- Managing requests for discretionary financial assistance submitted in relation to the work of Defence, including gathering information and providing advice to assist decision makers to determine claims.
- Providing support to the Defence Force Advocate and Defence Force Remuneration Tribunal processes.
- Drafting, reviewing and providing legal advice on various legal documents, including ministerial submissions, briefs and correspondence.
- Providing strategic advice to assist internal Defence clients to improve decision making and systems with a view to reducing legal risk.
- Working closely with other parts of Defence Legal, Defence and other parts of Government, to facilitate the provision of legal advice in accordance with the Legal Services Directions 2017.
- Supervising and mentoring junior members of the team.
Should your performance fall beyond requirements or the eligibility criteria not be met, your eligibility for the BDCP may be reviewed and ceased. It may also be ceased should you change positions or the requirement for the BDCP is no longer necessary, as determined by Defence. Should the BDCP be ceased you will be advised and your BDCP additional payment will cease.
**About our Team**
The Directorate of Employment Law and Discretionary Claims in Defence Legal provides legal and claims management services to internal Defence clients.
The small but growing team provides legal advice to Defence clients on matters relating to PGPA Act compliance and employment law issues and supervises access to external legal advice via the Whole of Australian Government Legal Services Panel where appropriate.
The DELDC Team play a crucial role in managing legal risk for Defence in the areas of Employment and Financial Governance.
We are seeking an APS 6 or EL 1 Legal Officer who has:
- Experience in Employment Law or the Commonwealth Financial Framework
- Administrative Law and decision making skills
- Excellent problem solving, communication, and client engagement skills
- Ability to lead and work collaboratively as a member of a team and manage competing priorities in a high tempo environment.
