Tasmanian Worker's Compensation Lump Sum Payments for Permanent Impairment Specialist

Workplace injuries can have a profound impact on an individual's life, affecting their physical and emotional well-being. In the event of a permanent impairment, workers may be entitled to lump sum compensation.
Permanent Impairment Claims in TasmaniaTasmanian workers are eligible for a permanent impairment claim if they have suffered an injury at work that has resulted in a whole person impairment of 5% or more. This type of claim is designed to provide compensation for the impact of the injury on an individual's life.
There are two types of permanent impairment claims: physical and psychiatric. For physical injuries, a worker must demonstrate a whole person impairment of 5% or more. In some cases, a worker may qualify for a lump sum payment if their injury relates to the loss of part or all of a finger or toe, even if their whole person impairment is less than 5%. On the other hand, for psychiatric injuries, a worker must demonstrate a whole person impairment of 10% or more, with the condition being directly caused by their workplace incident.
To be eligible for a permanent impairment claim, a worker's injury must have stabilized. This means that the impairment is unlikely to change substantially, regardless of any further medical treatment. Once this occurs, the injury is referred to as 'stabilized.'
Time Limits for Permanent Impairment ClaimsProvided that a worker's compensation claim has been made in accordance with the Act, there are no time limits which apply to making a claim for a permanent impairment lump sum compensation. However, delays in bringing a claim for a permanent impairment can negatively affect the potential for a successful claim.
It is essential for workers to seek legal advice as soon as possible if they think they may have an entitlement to a permanent impairment lump sum. Our team of experienced lawyers will guide you through the process and ensure that your claim is thoroughly prepared, maximizing the compensation payable to you.
Key Benefits:
- Lump sum compensation for permanent impairment
- No time limits for making a claim
- Experienced lawyers to guide you through the process
