Overview
The Attorney-General of the Australian Capital Territory invites Expressions of Interest from eligible and suitably qualified people for appointment as a Magistrate to the Magistrates Court of the Australian Capital Territory.
The Magistrates Court of the Australian Capital Territory has wide jurisdiction under the Magistrates Court Act 1930 and other legislation, including adult and children’s criminal matters, care and protection, civil matters including family and personal protection orders and commercial leases, industrial criminal and civil matters, and coronial inquests.
Role and Appointment
The Magistrate will exercise functions of a Magistrate of the Magistrates Court of the Australian Capital Territory, as arranged by the Chief Magistrate. Magistrates are not permitted to undertake other employment, except with the written consent of the Attorney General.
Eligibility and Selection
The eligibility, conditions and terms of appointment for a Magistrate are set out in the Magistrates Court Act 1930. The selection criteria for a Magistrate is set out in the Magistrates Court (Magistrates Appointment Requirements) Determination 2009, which can be found on the ACT Legislation Register at www.legislation.gov.au.
Remuneration and Merit
Remuneration, allowances and entitlements are set independently by the ACT Remuneration Tribunal (www.remunerationtribunal.act.gov.au). This expression of interest process may also be used to establish an order of merit to support future appointments as Magistrate over the following 12 months.
