About the role

This position is within the Regulatory Operations Group (ROG). The Regulatory Operations Group adopts a whole-of-system approach to regulation, using data and intelligence to prioritise where we focus our resources, and using a surveillance-based approach to monitor our regulatory systems.

Within the division, the Insolvency & Securities Investigations team is responsible for investigating alleged personal insolvency offences under the Bankruptcy Act 1966 (Bankruptcy Act) and preparing briefs for prosecution. The Insolvency & Securities Investigations team also investigates alleged breaches of the Personal Properties Securities Act 2009 (PPS Act). This work directly contributes to AFSA's reputation as a visible, modern and contemporary regulator safeguarding Australia's strong credit system.

Under broad direction, this role manages the day-to-day operations of the Insolvency & Securities Investigation team, including by overseeing investigations conducted within the team, engaging with key internal and external stakeholders, including AFSA Legal, CDPP and others.

This role will work closely with the Director to contribute to building stronger stakeholder confidence in the personal insolvency system and the personal property security system through effective regulation and enforcement activities that are timely, consistent and appropriate.

Key accountabilities

As an Assistant Director, your responsibilities will include the following:

  • Overseeing investigations and contraventions of the Bankruptcy Act and PPS Act and ensure complaints against alleged offenders are actioned appropriately.
  • Managing investigative activity on a 'greatest risk' approach to improve voluntary compliance and prosecution outcomes.
  • Managing and monitoring a team to ensure effective performance and service delivery in accordance with established policies and procedures, ensuring quality and implementing remedial action as required.
  • Undertaking highly complex enquiries, investigations and compliance activities including evidence collection, exhibit handling, preparing witness statements, conducting recorded investigative interviews and preparing briefs of evidence
  • Drive process consistency and cross-team collaboration to optimize investigation results.
  • Prepare high-quality briefings for senior executives on investigation outcomes, prioritisation and RAS priorities which supports informed decision-making and driving continuous improvement.
  • Identify emerging opportunities and issues, responding decisively to competing and shifting priorities, leading the team through change by communicating purpose and business direction with clarity and influence.
  • Travel to various places throughout Australia may be required for some operational aspects of the role.
Qualifications and experience
  • Experience working either as an investigator, an inspector or in a comparable technical regulatory/legal role will be highly regarded.
  • Relevant enforcement and management experience is highly desirable.
  • A Diploma of Government Investigations or equivalent, or the ability to obtain this within 12 months of commencement is essential.
  • Tertiary qualifications in Law, Accounting, or relevant discipline from an Australian tertiary institution (or comparable overseas institution), or the above-mentioned demonstrated equivalent experience are highly desirable.
