  The team
  
  ASIC's Enforcement and Compliance Group (ECG) is responsible for the conduct of ASIC's initial inquiries, compliance and enforcement work across all sectors excluding markets. The ECG comprises Investigation and Enforcement Action, Enforcement Inquiries and Compliance, Enforcement Services and Enforcement Policy and Practice.
  
  The role
  
  As a Senior Lawyer in ECG, you will;
  • Work across a range of large and complex investigations into suspected misconduct. Guide investigative teams in the development of investigation strategy, legal issues, planning and conduct of the investigation. Lead and manage resources to ensure timely and effective enforcement outcomes.
  • Utilise technology to analyse data, information and documentation in order to identify and present relevant evidence actively progress investigations.
  • Identify issues including complex legal issues arising in investigations that present challenges and overcoming the more complex of these. This may include advice as to evidence required to prove contraventions of legislation, admissibility of evidence in Court and the use of ASIC's statutory powers, and other technical, practical or legal issues.
  • Interview and obtain information from a range of witnesses and develop relationships with witnesses.
  • Give evidence at civil and criminal hearings about investigations.
  • Communicate with external parties in relation to issues arising during the course of the investigation and assist in the compilation of briefs for the Commonwealth Director of Public Prosecution (CDPP) and assisting them to prepare and conduct criminal prosecutions.
  • Compile administrative briefs to ASIC delegates, liaising with delegates and representing ASIC at administrative hearings.
    
    
  About You
  
  A suitable candidate for this role will have:
  • Must have a bachelor's degree in Law, admission to the Supreme Court of an Australian State or Territory as a solicitor or barrister and must hold (or be eligible) a current legal practicing certificate from the relevant State law society.
  • Significant experience in a senior role that involved investigation, case management, evidence gathering processes, project management or detection of misconduct, including the conduct of civil litigation and/or the preparation of criminal briefs of evidence.
  • Experience in conducting complex litigation
  • Extensive experience drafting statutory documents, witness statements, affidavits, and other formal legal documents to support litigation outcomes.
  • Understanding of the law, practice and policy relating to the Corporations Act, the National Consumer Credit regime, the ASIC Act and other relevant financial services legislation.
  • Strong legislative and evidence analysis skills
  • Demonstrated ability to use digital investigative tools
  • Highly developed writing and drafting skills, and the ability to communicate verbally in a clear, concise and persuasive manner.
  • Confidence presenting, building rapport, interviewing, and advocating an organisation's position in the context of complex issues.
