ABOUT THE ROLE(S)
We have been

exclusively briefed by the Federal Court of Australia (FCA) to fill Judicial Registrar - Migration positions which could be based in any Capital city of Australia (except Canberra). The FCA has jurisdiction in almost all civil (and some criminal matters) arising under Australian federal law. The Court can hear cases in relation to admiralty, bankruptcy, competition, consumer protection, corporations, fair work, human rights, intellectual property, and native title. It also has the power to review some Federal Government decisions in areas such as social security, immigration, and taxation.


The Court has recently undertaken important reforms through the implementation of the National Court Framework, which underpins the way the Court will operate moving forward, through adopting a modernised approach to case management and operations to be better placed to meet litigant needs.


The reforms extend to registrar work, aiming to ensure an efficient effective and nationally consistent approach to allocation and management of work and to create opportunities for the career advancement and development of the Judicial Registrars.

The Judicial Registrar - Migration is a multi-faceted position playing a key role within the reformed structure. Judicial Registrars - Migration

JRs-Migration) support judges in facilitating the just resolution of migration proceedings as quickly, inexpensively and efficiently as possible.

KEY DUTIES AND RESPONSIBILITIES:

  • Performing delegated judicial functions, including conducting migration lists and case management hearings, making determinations in relation to costs orders, fee waivers, competency, compliance with Court Rules and transfers between Courts and Registries, and performing urgent and duty registrar work in relation to migration matters as required.
- conducting high-level strategic analysis of the migration caseload with a view to understanding emerging trends, identifying matters that raise similar legal and/or factual issues.

  • Liaising with judges, court staff, court users and other internal and external stakeholders in relation to the FCA and FCFCOA migration workload.
  • Supporting the development of migration resources, policy, and practice by monitoring developments in migration law and periodically updating the migration practice area intranet resources.

REQUIRED SKILLS AND EXPERIENCE

  • Considerable experience in migration law including migration litigation.
  • A comprehensive understanding of case management principles.
  • A detailed understanding of the jurisdiction and practices and procedures of the FCA and the FCFCOA;
  • A proven ability to undertake analytical and legal work and critically evaluate a large volume of information in a highpressure environment and;
  • Work autonomously and with the necessary authority and accountability
  • Build and sustain positive relationships with a network of key stakeholders internally and externally.

FORMAL QUALIFICATIONS

must be admitted to the High Court and/or the Supreme Court of a State or Territory of Australia

Additional qualifications in migration law, e.g., Specialist in Immigration Law Accreditation, will be considered favourably but are not essential
