About the Branch

The Compliance Branch provides specialist services to support efficient and effective compliance actions across all CER schemes. These services can include actions and activities that will help the agency to better understand who the participants are and to explain their behaviours so that we can provide targeted and timely guidance and outreach activities to enable them to meet their obligations. The Branch can also help to detect non-compliance and to facilitate and enforce compliance within each scheme.

The Branch has four sections:

  • Compliance and Enforcement Section – undertaking proactive and reactive compliance activities including investigations and developing and delivering compliance and engagement programs to prevent, detect and address serious non-compliance across schemes administrated by the agency.
  • Intelligence and Assessment Section – providing a centralised intelligence function that produces tactical, operational and strategic insights to support business areas and undertaking a preliminary assessment triage function for all referrals received by the Branch and maintaining an ongoing participant monitoring function and coordinating engagement and collaboration with other regulators.
  • Participant Assessment Section – ensuring that those applying to participate in the schemes administered by the agency meet competency and capability benchmarks.
  • Compliance Strategy and Assurance Section – driving the engagement on strategic compliance policy initiatives, reporting on compliance effectiveness and providing a centralised scheme audit and assurance function.
About the Section

The Intelligence and Assessment Section provides several enabling functions including a centralised intelligence and assessment function to support scheme administration and entry, and compliance and enforcement actions. It is a dynamic area, with lots of opportunity for collaboration and exploration of the strategic environment. There is a strong culture of professional development and exposure to work areas across the agency, including direct engagement with senior management.

  • The Intelligence Function comprises the collection and analysis of information that aims to support the tactical, operational, and strategic decision making of the agency and to detect non-compliance.
  • The Preliminary Assessment Team undertakes a monitoring and assessment triage function for all complaints, referrals, tip offs and information and data requests that are received by the Compliance Branch.
Role Responsibilities and Duties

Under limited direction, an APS Level 5 Compliance Officer will:

  • Work as part of a multidisciplinary team responsible for recording, triaging, and assessing allegations of non-compliance in the schemes the agency administers, in line with agency KPIs.
  • Conduct preliminary assessments of referrals, including for those of moderately complex to complex matters, to determine whether suspected breaches of agency administered legislation or other relevant Commonwealth and State legislation may have occurred.
  • Prepare critical decision briefs and present matters to an operational decision group, providing recommendations on how allegations of non-compliance may be addressed.
  • Prepare reports for administrative purposes and undertake other administrative tasks as required, including the management of a shared email inbox.
  • Provide sound advice on triage matters pertinent to agency administered schemes, which influence the decisions made by others, including other business areas and peers.
  • Manage projects relevant to the proactive monitoring of non-compliance in the schemes administered by the agency and deliver outcomes in line with agreed KPIs.
  • Establish and maintain effective and productive working relationships with agency staff and counterparts in other agencies/authorities to achieve agency objectives.
  • Liaise with internal and external stakeholders to deliver positive outcomes.
  • Contribute to the setting of work priorities and practices, monitoring work-flow and developing continuous improvement procedures for the team.
  • Develop and maintain technical expertise in agency systems and data holdings.
  • Maintain accurate records in line with agency requirements and proactively undertake records management tasks and projects where required.

Under limited direction, an APS Level 6 Senior Compliance Officer will also, in addition to the above:

  • Conduct preliminary assessments of referrals, including complex matters, to determine whether suspected breaches of agency administered legislation or other relevant Commonwealth and State legislation may have occurred.
  • Actively supervise and mentor staff in accordance with the agency's performance management approach.
  • Manage projects relevant to the proactive monitoring of non-compliance in the schemes administered by the agency and deliver outcomes in line with agreed KPIs and provide guidance to less experienced members of the team to do the same.
  • Build staff capability in a multi-disciplinary team environment and identify opportunities to provide input into developing, implementing and/or improving operational procedures.
Qualifications/Experience

Qualifications

None required, however a Certificate IV in Government Investigations would be highly regarded.

Experience

The following experience is required for both Compliance and Senior Compliance Officer:

  • Previous experience working in a compliance, law enforcement or investigations role.
  • Experience in and practical ability to interpret and apply legislation, regulations and policies to determine appropriate courses of action.

Additional requirements for Senior Compliance Officer:

  • Previous experience in a team leadership/mentoring role.

The following experience will be highly regarded for both roles:

  • Using databases and information reporting systems.
  • Working as part of a multi-disciplinary team.
