Primary objective
Manage the Agency's response to requests for information including Freedom of Information, court and legal requests, in consultation with
Department of Corporate and Digital Development, program areas, and the Manager. Support the Agency to meet its responsibilities in promoting
best practice and provide advice and training in accordance with the applicable components of the associated legislation.
Context statement
The Legal, Freedom of Information and Complaints team sits within the Professional Standards unit under the Office of the Commissioner and
ensures Department of Corrections is effectively and efficiently fulfilling its obligations under relevant legislation, while improving Chief Executive
oversight and access to legal support, in consultation with the Solicitor for the Northern Territory and other legal service providers.
Key duties and responsibilities
1. Manage the processing and provision of material requested under court summons and subpoena, warrant and other types of information
sharing requests, ensuring compliance with relevant legislation and court rules.
2. Manage the processing of Freedom of Information applications in conjunction with DCDD and other forms of information release in
compliance with the Information Act 2002, the Care and Protection of Children Act 2007, the Youth Justice Act 2005 the Correctional Services Act
2014 and any other relevant legislation.
- Provide advice and support to staff, external applicants and other stakeholders in relation to the management and handling of client
information in line with relevant legislation and legal advice.
- Contribute to the development and maintenance of Agency guidelines and procedures to ensure best practice in handling personal information
and compliance with the Information Act 2002.
- Provide support and guidance to the Information Support Officer and Legal Support Officer.
- Effectively manage monitoring and reporting mechanisms as required.
- Provide ad-hoc administrative and paralegal support to the wider Legal, Freedom of Information and Complaints team.
Selection criteria
Essential
1. Proven ability to interpret and apply legislation and provide advice on complex matters.
2. A detailed working knowledge of the issues, principles and practices in the areas of court processes, freedom of information and information
privacy.
3. Demonstrated effectiveness in a highly sensitive, confidential, and complex environment with a high level of integrity, discretion and
confidentiality.
4. High level of interpersonal, oral and written communication and reporting skills with strong ability to gain the cooperation of internal and
external clients.
5. Well-developed organisational skills with high levels of self-motivation and an ability to think and act strategically.
6. Demonstrated organisational and time management skills with the capacity to prioritise competing requirements, work under pressure and
meet critical deadlines while maintaining quality control.
7. Demonstrated ability to adapt positively to change, manage conflict and contribute to a positive team environment.
Desirable
1. Demonstrated experience undertaking release of information in a complex legislative environment.
2. Well-developed practical understanding of records management and computerised information systems.
3. Experience using client record systems including CARE, and the Integrated Offender Management System
