**About the role**:
The Misconduct Disciplinary Advice Unit (MDAU) is a business unit of the Incident Management Directorate (IMD) and provides expert advice while managing disciplinary processes arising from investigations into allegations of employee misconduct. The disciplinary and legislative framework of the MDAU functions is guided by common law principles, The Public Sector Act 2009 and the Education and Children’s Services Act 2019; and related review and appeal processes.
MDAU staff work collaboratively with other departmental units and external agencies while acting in an unbiased, impartial manner which considers the rights of individual employees. High-level communications in the form of briefings to the Chief Executive or relevant delegate are required to set out the courses of action recommended and reasonably open in the various phases of disciplinary processes.
The Principal Disciplinary Review and Adjudication Officer (DRAO) is accountable to the Manager, Misconduct and Disciplinary Advice Unit and is responsible for providing leadership, high quality advice and guidance to Disciplinary Review and Adjudication Officers. The Principal DRAO is also responsible for conducting disciplinary processes in line with standards and principles of natural justice and procedural fairness and within specified timelines, exercised to minimise risk to the safety of children and students, the well-being of employees and the reputation and financial risk of the Department for Education.
**About you**:

- **Analysis**: Experience in high-level research and analysis of legislation, case law, and industrial instruments.

- **Communication**: Exceptional written/verbal skills with professional representation abilities.
- **Workload Management**: Experience in managing complex caseloads with competing priorities and tight deadlines.
- **Conflict Resolution**: Skilled in negotiation and high-level consultative guidance.
- **Risk Management**: High integrity standards with disciplinary process experience.
- **Specialist Knowledge**: Knowledge of SA Public Sector frameworks including Public Sector Act 2009 and Education and Children's Services Act 2019.
**Qualifications**:
**Essential**: Nil
**Desirable**:
- Legal or para legal experience.
- Adjudication or complaints resolution.
- Legal services or Law Degree Qualification.
**Special conditions**:
The successful applicant is required to gain a Department for Human Services (DHS) working with children check (WWCC) prior to being employed which is required to be renewed every five years before expiry. The incumbent will be required to undertake RRHAN -EC (Responding to Risks of Harm, Abuse and Neglect - Education Care) Facilitator Lead (Masterclass) extended course or the online (Fundamentals) course which will be required to be updated every three years.

**Remuneration**:
- ASO8 $121,107 - 125,679 per annum (1.0 FTE) + superannuation (11.5%) and leave loading
