The Independent Assessor has the following functions under the Act:

- Assess, investigate and deal with the conduct of councillors if it is alleged or suspected to be inappropriate conduct, misconduct or, when referred to the Assessor by the Crime and Corruption Commission, corrupt conduct.
- Provide advice, training and information to councillors, local government employees and other persons about dealing with alleged or suspected inappropriate conduct, misconduct or corrupt conduct.
- Manage the prosecution of offences against conduct provisions.
- Investigate other matters decided by the Minister.

In addition, the Independent Assessor will
- Provide strategic leadership to the Office of the Independent Assessor as a highperforming, effective, professional and ethical authority, which fosters improved integrity in local government.
- Promote high standards of conduct by elected representatives of local governments.
- Provide an annual written report to the Minister, which the Minister will table in the Legislative Assembly.

Under the Act, a person is qualified to hold the office of the Independent Assessor if the person has extensive knowledge of, and experience in any of the following areas:

- Local government
- Investigations
- Law
- Public administration
- Public sector ethics
