Role Responsibilities

As an Associate, you will tackle a diverse array of stimulating and complex commercial litigation and dispute resolution cases. Our clientele includes publicly traded corporations, top-tier insolvency firms, and family-owned enterprises.

Your responsibilities will encompass advising clients, briefing and instructing counsel, and engaging deeply in various commercial litigation and insolvency issues, such as:

  • Complex commercial disputes
  • Building and construction conflicts, including matters under the Security of Payment Act
  • Property disputes
  • Shareholder, partnership, and franchise disagreements
  • Debt recovery, including intricate recovery proceedings

Additionally, you will be actively involved in numerous front-end and back-end insolvency-related tasks, such as advising insolvency practitioners throughout the external administration process, including during administrations, receiverships, and liquidations. You will also participate in proceedings related to voidable transactions, claims against former company officers, public examinations, and fee approval applications.

Furthermore, you will gain invaluable experience by managing bankruptcy proceedings and cases in the New South Wales Civil and Administrative Tribunal across a variety of disputes, including overseeing the daily conduct of such matters.

Candidate Profile

  • 3-5 years PQE in commercial litigation and insolvency, whether as a paralegal or post-study.
  • Demonstrated ability to collaborate effectively, working both independently and as part of a team.
  • Strong commercial insight and confidence in developing solid client relationships, with a keen understanding of their unique business requirements.
  • Exceptional technical, analytical, communication, and research skills to provide commercially sound advice.
  • Proactive in identifying and addressing potential challenges, ensuring clients are well-prepared and confident throughout the litigation journey.
  • Meticulous attention to detail in evidence preparation, court document drafting, and client consultations.
  • Familiarity with civil procedure rules in Federal and NSW Courts, rules of evidence, and the Building and Construction Industry Security of Payment Act 1999, including the adjudication process.
  • Proven capability to effectively brief and instruct counsel, facilitating interactions to secure favorable settlements.
  • Commitment to continuous professional development, with a focus on enhancing expertise in insolvency law and practice.
