This role is part of the Disciplinary Action Unit, responsible for handling disciplinary proceedings against Licence Holders in the Building Industry.
- The unit makes determinations on complex matters of fact and law, as well as the appropriate disciplinary action.
- Disciplinary actions may include imposing monetary penalties or implementing licence conditions, such as restrictions or remedying misconduct.
- The unit also decides whether to suspend or cancel building licences of both small and large entities in NSW.
The Principal Disciplinary Officer assists senior decision delegates and exercises executive decision-making functions similar to a member of the NSW Civil and Administrative Decisions Tribunal in its administrative and equal opportunity jurisdiction.
This role is suitable for a legal professional with experience in litigation, drafting, or regulatory decision making. Candidates should have an interest in regulatory law and practice and demonstrate strong skills in statutory and factual analysis, as well as the ability to draft complex documents.
Key Responsibilities- Consider referred briefs of evidence and submissions from licence holders and other affected parties.
- Recommend and determine disciplinary action through administrative decisions.
- Prepare notices to show cause, draft decisions on factual and legal matters, and take appropriate disciplinary action.
- Work collaboratively with internal and external stakeholders, including investigators, inspectors, mediators, lawyers, traders, and consumers.
- Supervise, train, and develop more junior staff in the team.
- A minimum of 5 years of experience as a solicitor or in a relevant field, including understanding legislation and applying it in a regulatory environment.
- Strong analytical and drafting skills, knowledge of investigative processes, and application of the rules of evidence and principles of procedural fairness and natural justice.
- Superior written communication skills, with the ability to express complex issues in a concise and logical manner.
