Commercial Lawyer

As a Commercial Lawyer, you will be part of a team that provides high-level contract management advice and support to staff and management of the FCA, FCFCOA, and National Native Title Tribunal.
Key Responsibilities:- Provide expert, timely, clear, comprehensive, and solution-focused legal advice and drafting on a range of commercial transactions, including goods and services procurement, IT contracts, intellectual property, professional services agreements, accreditation agreements, commercialisation licences, commercial property transactions, and regulatory agreements.
- Initiate and provide legal research and analysis on contentious commercial issues to support core objectives and manage a diverse portfolio of matters while exercising effective stakeholder management.
- Draft high-quality, clear, and concise legal documents, including legal instruments, advice, and documents, to achieve high-quality outcomes and enable effective decision-making.
- Implement policies, processes, and procedures and educate stakeholders to ensure organisational compliance with laws and mandatory policies.
- Collaborate with teams, provide expert specialist advice and guidance, and work as part of a team to coordinate and influence outcomes that align to organisational and commercial objectives and parameters.
- Provide contract management services to the Courts and Tribunal, including the preparation of requests for tender, contract risk analysis, development and negotiation of contract terms and conditions, and the management of contract performance.
- Contribute to knowledge sharing and capability development across the Office of General Counsel and with internal clients to drive awareness of commercial legal issues and improve project planning and decision-making.
- Minimum of 3 years' experience as a solicitor, holding an unrestricted practising certificate or eligibility to hold an unrestricted practising certificate in NSW.
- Three or more years of contract law experience.
- Experience in, and knowledge of, general commercial, contract, and administrative law.
- Selection criteria include experience at senior management level, including strategic planning and management of projects and resources (internal and external) and demonstrated capability as a facilitator of change.
- Demonstrated experience in a range of contract management functions, including tender and contract development and management, risk management, and preferably including performance management in a contracting environment.
- Understanding of the broader Government reform agenda and initiatives, including fiscal and contract reforms.
- High-level communication skills, including negotiation and influencing skills to deal with internal and external parties; contract negotiation; ability to represent the Court in an external environment and to communicate regarding change issues at all levels.
- Highly developed analytical and problem-solving skills to define issues, develop options, assess feasibility, and determine resources and other considerations.
- Demonstrated interpersonal skills to deal with a variety of people from diverse backgrounds, often under difficult circumstances.
