The team

The Small Business, Engagement & Compliance team is responsible for promoting ASIC's vision for small business through engaging, assisting and helping to protect small business in Australia. The role of the team is to conduct engagements, assessments and regulatory action (including compliance, surveillance, investigation and summary prosecution work) on reports of misconduct and breach notifications. The team also raises awareness of compliance obligations and conducts surveillances to identify breaches of the legislation.

The roles
As a member of the Small Business, Engagement & Compliance team, you will be responsible for:

- Assessing alleged misconduct and conduct compliance activity which may lead to criminal prosecution or civil action
- preparing and conducting summary regulatory prosecutions and civil actions across jurisdictions. Travel to appear in court as required
- conduct legal research and provide technical advice
- manage all aspects of prosecution workflow in accordance with set timeframes and procedural requirements
- ensuring that ASIC complies with current court rules and regulations
- compile briefs of evidence and recommend alternate actions
- developing and maintaining relationships with key internal and external parties including insolvency practitioners, Commonwealth and State regulatory and prosecution agencies.

About you
We are looking for someone with Bachelor's degree in law and admission to the Supreme Court of an Australian State or Territory as a solicitor or barrister. You must hold (or be eligible) a current legal practicing certificate from the relevant State law society. Ideally you would have at least 3 - 5 years post admission legal experience in criminal law. Strong advocacy experience conducting criminal or civil litigation in a government agency or legal firm is strongly regarded, as well as proven experience preparing briefs of evidence and an understanding of criminal and administrative litigation procedures.
You will have experience in researching, analysing and interpreting complex information, providing technical advice and recommending alternative actions. Technical knowledge and practical experience in the area of insolvency law and regulatory, legal or compliance experience is highly desirable.
