About the Role
Reporting to the Senior Workstream Lead: Governance, Legal and Risk, you will be a trusted legal advisor to the Director of Schools, Senior Workstream Leads and all System Leaders, for all legal matters and in particular; anti- discrimination, Education Act compliance, personal injury and matters with parish and canonical implications.
Dispute resolution including matters relating to family law and contracts is also a responsibility of this role where you will provide support as required to the Director of Schools and Manager of Safeguarding.
As the Senior Legal Counsel, you are able to identify legal concerns across the work of CSBB schools and Central Office and collaborate effectively with professional staff to manage legal risk.
As a member of the Governance, Legal and Risk team you will be responsible in high volume of operational accountability and working strategically to support the delivery of specific initiatives and priorities within the scope of Towards 2025.
Key Role Responsibilities:
- Leads the CSBB Legal Team, under the direction of the Senior Workstream Lead, Governance, Legal and Risk
- Provides advice on complex legal matters, including the intersection of various legislation
- Operates as a subject matter expert on section 83C compliance, safeguarding, parish and diocesan matters, workers compensation and antidiscrimination, especially the Disability Standards for Education
- Provides timely and appropriate legal advice for system leaders in keeping with a legislatively complex environment in the education sector including where required, support for the Manager of Safeguarding.
- Liaises with external lawyers and briefs external counsel as required to provide advice, appear in proceedings or prepare draft responses and/or documentation particularly relating to complex and involved matters, including where canonical advice is needed
- Develops comprehensive briefings for the Director of Schools, and board reporting as appropriate
- Reviews policy and practice from a legal perspective
- Oversees day to day legal matters including contract review, response to subpoenas, letters of demand and general legal questions
- Liaises with insurers and lawyers for insurers regarding legal matters, insurance claims and risk management
- Oversees systems for the coordination and preparation of legal documents as requested by Government Inquiries, Courts, Tribunals and Diocesan agencies
- Acts on behalf of CSBB and its officials (as required) in relation to small scale litigation and alternative dispute resolution
- Undertakes research into specific aspects of the law including regulatory regimes and compliance matters, responses to foreshadowed changes to legislation, new legislation or the creation of new regulatory regimes and associated legislation that may impact CSBB
- Assists CSBB to operate in compliance to legislation and its values at all times
About You
As the ideal candidate you will meet the following key requirements:
- Supportive of, or can demonstrate an understanding and commitment to, the ethos of the Catholic faith in an educational context
- Admission as a Legal Practitioner of the Supreme Court of NSW with at least 10 years’ experience
- Previous responsibility for delivering legal services in a complex organisation, ideally in a not-for-profit or educational setting
- Experience in developing and leading an in-house legal function, and people leadership an advantage
- Proven record in sustaining effective relationships and maintaining effective networking across a broad range of stakeholders
- An ability to provide legal services and functions to support an organisation’s mission
- Familiarity with the Canonical and Ecclesial context of Catholic schools (desirable)
- Experience in the management of safeguarding matters from a legal perspective (desirable)
- Working knowledge of the legal and regulatory environment governing NFP organisations
- Previous experience managing litigation is an advantage
- Adaptable to working within a fast-paced environment and re-prioritising tasks
- Having a keen eye for detail to deliver consistently accurate and informed written and verbal communications suitable for the receiving audience
- Advanced knowledge and skill in the Microsoft suite of products
Qualifications
- Tertiary qualification in Law
- Current practising certificate in NSW
- Member of The NSW Law Society and/or Association of Corporate Counsel (ACC) Australia
- Valid Working with Children Check
