What you’ll contribute to

An exciting opportunity has arisen for a driven Senior Intellectual Property Lawyer to join our Aftersales Division in a Max Term role for 12 months.

The Aftersales Division is responsible for planning, coordination and execution of all national parts and accessories activities including sales, business development, procurement, supplier management, Dealer support and warehouse operations in order to achieve sales volume, market share, profitability objectives and optimise warehouse operations to global best standards.

The Senior Intellectual Property lawyer role is primarily responsible for supporting with the protection of Toyota Australia’s intellectual property rights in respect of parts and accessories as well as repair and collision services. This includes:

1. Trade mark and copyright infringement with particular focus on counterfeit Toyota parts and accessories sales; and

2. Australian consumer law infringement such as misleading and deceptive conduct.

This role is based in Altona North with flexible work arrangements on offer.

How you’ll make an impact

Manage intellectual property infringement and ACL cases by maintaining TMCA’s case management records, conducting investigations, and gathering evidence to ensure cases are progressed and resolved in a timely manner. This includes but is not limited to:

Draft and review letters of demand;

Manage litigation cases and lead the negotiation throughout court proceedings;

Manage Australian Border Force seizures;

Manage evidence and investigations by conducting trap purchases, liaising with investigators, and ensuring evidence is adequately verified and stored; and

Lead, review and present monthly reports in relation to Team’s KPIS and draft bulletins and presentations for TMCA and Dealers.

Manage TMCA’s parts policy matters.

Manage the commercial relationship with TMCA’s suppliers, including conducting annual reviews of master agreements and statements of works.

Provide training to Australian Border Force officers in respect of TMCA notice of objections and product verification.

Lead and facilitate the creation of marketing materials when required to raise counterfeit awareness.

Your attributes

Must have: (1) Degree qualification in law (hold a Victorian legal practicing certificate or Trade Marks Attorney registration with Trans-Tasman IP Attorney Board); and (2) intellectual property law and consumer law experience.

Desired qualification(s):

Graduate diploma or master in intellectual property law.

Strong organisation, planning and communication skills.

High level of attention to detail.

Strong critical thinking and data-analysis skills.

Excellent use of MS Office, including Excel.

Exceptional written and verbal communication skills.
