Overview:
The Investigations and Compliance team is a newly formed team with the responsibility of leading compliance activities under Part 4 of the Tobacco and E-Cigarette Products Act 1997 (Restrictions on Smoking / Smoke Free Areas).
The Compliance Officer is responsible for:
- Coordinating, executing and reviewing programs and projects which support the effective administration of the _Tobacco and E-Cigarette Products Act 1997_ (TEP Act) and _Controlled Substances Act 1984 _(CS Act) across South Australia.
- Reviewing legislation and developing and implementing sound programs, plans, protocols and tools for the implementation, monitoring of compliance and enforcement of requirements.
- Reviewing, assessing and reporting on matters in relation to legislation and regulatory programs.
- Addressing complex breaches of licencing, incidents, complaints and enquiries, and investigating of alleged breaches of legislation in relation to restrictions on smoking (smoke free areas) and poisons classified in the Poisons Standard (the SUSMP).

- Developing and implementing practical compliance approaches and tools to support the monitoring and enforcement of the TEP Act and CS Act across South Australia. This includes working with internal and external stakeholders to ensure legislative requirements are clearly understood and effectively applied.
- Educating industry and the public on compliance obligations, preparing accurate, evidence-based reports suitable for legal proceedings, conducting complex investigations and proactive site visits, managing complaints and public enquiries, and carrying out enforcement actions in response to alleged breaches of the TEP Act and CS Act_._

**Criminal History Screening Requirement**
- A National Police Certificate (NPC) for employment involving no contact with vulnerable groups is required for this position (general employment).
**Immunisation Risk for this position is Category C (mínimal patient contact)**
SA Health Services are required to implement the Addressing vaccine preventable disease: Occupational assessment, screening and vaccination policy in the workplace.
**Special Conditions**
- Some intrastate (particularly to regional country areas) work requiring overnight stays may be required.
- A current South Australian Drivers Licence and a willingness to drive are essential.
- The incumbent will be required to work after hours, including weekends to undertake monitoring of compliance with the requirements of the EM Act and/or other SA public health legislation.
**ASO5**
- Eligible for appointment as an Authorised Officer under the TEP Act and CS Act.
**PO2**
- A relevant science degree, such as chemistry, toxicology, biochemistry or environmental health.
- All staff to achieve the learning outcomes defined for levels one and two as per The Aboriginal Cultural Learning Framework. Additionally, managers and staff in leadership roles will be required to achieve the learning outcomes defined for level three of this framework.
