**Who is the National Heavy Vehicle Regulator?**
The National Heavy Vehicle Regulator (NHVR) commenced operations in 2013 as a national entity responsible for
regulating all vehicles in Australia over 4.5 tonnes gross vehicle mass. Located in Brisbane, the NHVR minimises the
compliance burden on the heavy vehicle transport industry, reduces duplication and inconsistencies across state and
territory borders, and ultimately for the heavy vehicle business with government in Australia.

Position Description | Principal Prosecutor (NSW)
**Environment**
Through leadership and influence, the NHVR administers a national system that delivers consistent and streamlined
regulatory services and administration to the Australian heavy vehicle road transport sector, reducing regulatory burden
whilst enabling greater safety and productivity.
The Statutory Compliance Division ensures compliance with regulatory policy, strategy and standards through
investigation and prosecution of significant noncompliance and providing intelligence services throughout NHVR.
**Primary Objectives**
Manage, prepare and conduct complex prosecutions as required, including the engagement and instruction of counsel
and management of private sector lawyers and to provide strategic and specialist direction, support and advice to the
Practice Manager and Director Prosecutions on all matters relating to: prosecutions, court outcomes and orders register
management and coroners briefings.
**Key Responsibilities/Accountabilities**
- Manage and appear in complex prosecutions on behalf of the National Heavy Vehicle Regulator.
- Appear as counsel in complex prosecutions across all jurisdictions and all levels of court on behalf of the National
Heavy Vehicle Regulator.
- Deliver impartial, professional and quality adjudications, court appearances (summary hearings, call-overs and
appeals), disclosure of information, legal advice and written correspondence.
- Motivate and mentor junior staff to deliver high quality prosecution services on behalf of the National Heavy Vehicle
Regulator.
- Assist with coordinating a range of activities relating to the conduct of prosecutions including managing challenging
caseloads to achieve satisfactory completion of individual cases in a timely manner.
- Develop and maintain an active working knowledge of legal constraints and precedents relating to matters of law
which could influence proceedings for breaches of the Heavy Vehicle National Law and Regulations.
- Interpret and provide expert advice to operational staff and prosecutors in relation to legislation and regulations
relating to offences pursuant to the Heavy Vehicle National Law.
- Attend and prosecute in various Courts including Local, District, Supreme and Coroners Courts on behalf of the
National Heavy Vehicle Regulator.
- Participate in sensitive and complex negotiations to facilitate the achievement of early resolution of cases.
- Provide high level analysis, research, information and expert advice to assist in the development of programs and
policies to support the delivery of effective and efficient prosecution services on behalf of the National Heavy Vehicle
Regulator.
- Liaise with stakeholders, enforcement partners, legal practitioners and court officers regarding the conduct of
prosecutions.
- Ensure the delivery of a high standard of customer service for internal and external clients.
