**Position Overview**
As the Manager (Mediation) you will support the Director, Dispute Resolution & Assistance managing a team of case management staff involved in a range of dispute resolution activities relevant to the right to negotiation provisions of the Native Title Act 1993 (Cth). The role requires coordinating and leading the NNTT’s future act mediation functions and activities. In particular, this means providing legal and policy support to the Director, Dispute Resolution & Assistance in relation to the NNTT’s mediation function, practice and procedure, as well as on individual matters, other facilitative dispute resolution assistance and stakeholder capability and engagement.
The position requires strong people management and leadership skills, with an emphasis on capacity-building and policy development. Alongside the coordination of activities in support of the NNTTT’s mediation functions, the role leads the NNTT’s mediation practice and provides expert advice to inform the strategic direction of the Dispute Resolution & Assistance Team. Consultation and collaboration with the NNTT’s leadership group and Tribunal Members is a key requirement of the role’s internal engagement activities, as well as liaison with the President and Registrar on relevant issues.
**Key Duties and Responsibilities**
- Coordination and Work Allocation: Coordinate and manage the allocation of future act mediation assistance, including in relation to future act inquiries, within the Dispute Resolution & Assistance team, ensuring the effective delivery of a dispute resolution service and case management support to achieve organisational objectives.
- People Management and Development: Define and supervise performance and development objectives for staff, delegate responsibilities, set priorities and conduct annual performance evaluations within the Dispute Resolution & Assistance team; develop team capability through advice, coaching and formal performance appraisals and work with the Director, Dispute Resolution & Assistance to foster a multi-disciplinary ‘community of practice.’
- Planning and Excellence: Collaborate with Director, Dispute Resolution & Assistance to develop and coordinate the strategic direction of the work area in the context of long-term and organisational planning objectives; identify and implement change and business improvement strategies, including by leading the consolidation and maintenance of policies, procedures and guidelines; and demonstrate leadership in fostering a culture of excellence.
- Internal and external relationships: Build productive working relationships with the Tribunal President and Members NNTT Registrar in support of the NNTT’s mediation functions and collaborate with senior management to build and sustain constructive working relationships with external stakeholders in the context of broader dispute resolution activities.
- Business Innovation: Foster an organisational community of knowledge and practice about mediation, particularly in the context of future act negotiations and post-determination disputes; in collaboration with the Director, Dispute Resolution & Assistance, and the Manager (Arbitration), review, develop and maintain case management, workflow tools and systems to improve performance, enhance capabilities and meet statutory obligations.
- Legislative Compliance: Monitor compliance with internal policies relating to the NNTT’s mediation functions; identify gaps in practice and procedures; and ensure policies are up-to-date and consistent with the Native Title Act 1993 (Cth) and regulations and principles of administrative law and public administration; exercise general oversight of performance standards and consistency of practice within the Dispute Resolution & Assistance team.
- Legal Support: Provide expert legal support to the Director, Dispute Resolution in relation to the NNTT’s mediation functions, practice and procedures and on individual matters, as required; participate in complex and/or sensitive dispute resolution activities in support of the NNTT’s statutory functions.
- Public Administration: Adhere to the Australian Public Service Values and Code of Conduct, including the ability to operate as an effective and impartial representative of the Tribunal.
**Selection Criteria**
- Possessing and demonstrating an understanding of the issues affecting, and the ability to communicative sensitively and effectively with, Aboriginal and Torres Strait Islander people.
- Knowledge of the Native Title Act 1993 (Cth) and the operating context of the NNTT, or the ability to quickly acquire it, and principles of administrative law, dispute resolution and case management practice.
- High-level communication and interpersonal skills, including the ability to lead and motivate team members and constructively engage with and influence peers.
