Role Responsibilities:
As an Associate, you will manage a diverse range of stimulating and complex cases in commercial litigation and insolvency. Our varied clientele includes publicly traded corporations, premier insolvency firms, and family-owned enterprises.
Your responsibilities will encompass advising clients, briefing and instructing counsel, and actively participating in numerous commercial litigation and insolvency matters. This includes:
- Complex commercial litigation and construction disputes, including matters under the Security of Payment Act.
- Property disputes, shareholder, partnership, and franchise disagreements.
- Debt recovery processes, including intricate debt recovery actions.
- Involvement in various insolvency-related matters, advising practitioners throughout the external administration stages, and engaging in litigation concerning voidable transactions and claims against former company officers.
You will gain invaluable experience through direct involvement in bankruptcy proceedings and cases in the New South Wales Civil and Administrative Tribunal, managing a variety of disputes.
Candidate Profile:
- A minimum of 3-5 years PQE in commercial litigation and insolvency, whether as a paralegal or post-study.
- Demonstrated ability to collaborate effectively, both independently and as part of a team.
- Strong commercial insight and the ability to cultivate robust client relationships, understanding their unique business requirements.
- Exceptional technical, analytical, communication, and research skills to provide insightful legal advice.
- Proactive in identifying and addressing potential challenges, ensuring clients are well-prepared throughout the litigation journey.
- Meticulous attention to detail in evidence preparation, court document drafting, and client advisement.
- Familiarity with civil procedure rules in Federal and NSW Courts, evidence rules, and the Building and Construction Industry Security of Payment Act 1999.
- Proven experience in briefing and instructing counsel effectively to facilitate favorable resolutions.
- Commitment to continuous professional development, particularly in insolvency law and practice.
