Job Summary

The Statutory Oversight Team within the Legal Group at Comcare (Australian Government) is seeking an APS5 Legal Adviser to provide expert advice on the application of statutory processes to business areas within the organization.

About the Role

The APS5 Legal Adviser will be responsible for ensuring Comcare's compliance under various statutory processes, including the Freedom of Information Act 1982, the Public Interest Disclosure Act 2013, the Privacy Act 1988, and the Ombudsman Act 1976. The role will also involve managing Comcare's risk and ad-hoc niche areas of work by liaising across all of Comcare's functions and business areas.

Key Responsibilities

  • Deliver Comcare's privacy function, including actively promoting privacy, developing training, undertaking Privacy Impact Assessments, and ensuring all Comcare activities are consistent with the Privacy Act.
  • Manage Comcare's freedom of information function, including reviews and appeals, and act as Comcare's liaison with the Office of the Australian Information Commissioner.
  • Undertake an integrity role, including receiving Public Interest Disclosures (PID) and National Anti-Corruption Commission matters, and coordinating PID investigations.
  • Act as Comcare's liaison with the Commonwealth Ombudsman and prepare responses to their enquiries and investigations.
  • Assess and report on Comcare's model litigant compliance.
  • Undertake oversight functions, including managing escalated complaints.
  • Manage Comcare's administrative release function.

Requirements

  • Undergraduate degree in law.
  • Admission as a legal practitioner of the High Court or the Supreme Court of an Australian State or Territory.
  • Current Practising Certificate or ability to obtain one within three months.
