About the Role

BESIX Watpac is a leading construction company in Australia and New Zealand, with a rich history of delivering complex projects across various sectors. We are seeking a highly skilled and experienced Senior Legal Counsel to join our dynamic team in Sydney.

Key Responsibilities
  • Contract Compliance: Ensure that all business units within BESIX Watpac comply with our policies and procedures, and advise on contract interpretation and administration.
  • Contractual and Legal Risks: Identify and advise on key contractual and legal risks, and provide guidance on risk management and dispute avoidance.
  • Legislative Requirements: Advise on relevant legislative requirements and ensure that BESIX Watpac's policies are regularly updated to reflect these.
  • Commercial Benchmark Reviews: Prepare legal and commercial benchmark reviews of tender head contracts.
  • Tender and Contract Discussions: Attend tender, contract, and dispute resolution discussions and negotiations.
  • Special Conditions: Prepare special conditions to BESIX Watpac's template suite of agreements to ensure compliance with head contract requirements.
  • Subcontractor and Consultant Agreements: Review and respond to proposed departures by subcontractors and consultants to BESIX Watpac's template suite of agreements.
  • External Lawyer Management: Instruct and manage external lawyers.
  • Document Review and Drafting: Review and draft amendments to various forms of construction documents, including warranty deeds, settlement deeds, and novation deeds.
  • Confidentiality Agreements and MOUs: Review and update confidentiality agreements and MOUs, and draft necessary amendments.
  • Policy Updates: Review and update BESIX Watpac's template suite of agreements to incorporate legislative changes and/or streamline processes.
  • Training and Development: Assist in developing and delivering training on contract interpretation and administration.
  • Dispute Resolution: Assist in the management of formal legal disputes, including security of payment, contract disputes, HBA, and the Design and Building Practitioners Act.
  • General Legal Advice: Provide general legal advice to the business, including with respect to IT, HR, marketing, and WHS matters.
Requirements
  • Tertiary Qualifications: Tertiary qualifications in law.
  • Practicing Certificate: Holding a practicing certificate in NSW.
  • Construction Law Experience: Solid experience in construction law, preferably with front-end experience.
  • Research and Analytical Skills: Research and analytical skills related to legal matters.
  • Problem-Solving Skills: Sound problem-solving skills and the ability to exercise balanced and commercial judgment.
  • Attention to Detail: High level of attention to detail.
  • Communication and Relationship-Building Skills: Ability to communicate, influence, and build effective relationships at all levels of the business.
  • Autonomy and Decision-Making Skills: Demonstrated ability to operate autonomously using initiative, sound reasoning, listening, and decision-making skills.
