About the Role

CMC Markets Stockbroking Limited is seeking a highly skilled and experienced Senior Legal Counsel to join our APAC Legal team. As a key member of our team, you will be responsible for delivering high-quality legal services to our CFD and Stockbroking business in Australia and the APAC region.

Key Responsibilities
  • Report to and maintain a close working relationship with the Head of Legal, APAC, identifying key issues and driving solutions with a problem-solving and forward-thinking mentality.
  • Manage a team of junior lawyers, supervising their work and mentoring their softer skills to foster a collaborative and effective legal team.
  • Drive the preservation of the effective function of the legal team, steering or developing internal processes or policies as needed.
  • Engage with external legal firms, effectively managing relationships to ensure quality advice within approved budgets.
  • Provide strong legal skills in general commercial contract review and complex negotiation, with experience in OTC derivatives or non-leveraged securities trading highly regarded.
  • Assist with the management and review of CMC Markets legal disclosure documents and other terms for both the CFD and stockbroking businesses in Australia and the APAC region.
  • Experience in matters relating to aspects of the Corporations Act, ASIC Act, Privacy Laws, and IP, with exposure to financial services licensing, privacy laws, and general regulatory reform.
  • Communicate legal advice to a range of audiences, including APAC Senior Management, and provide training and support to staff on legal issues as required.
  • Provide legal input into Global or APAC policies and procedures, and provide legal advice to other areas of the business, including marketing, PR, HR, and IT.
  • Guide and negotiate in disputes, including client disputes and debtors, and general dispute and litigation disputes.
Requirements
  • Practising solicitor with an unrestricted licence and at least 8 PQE, with a mix of solid in-house and private practice experience.
  • Demonstrated ability to manage junior lawyers and strong legal skills in contract review, advice provision, and transactional or project work.
  • Excellent organisation, analytical, and negotiation skills, with the ability to effectively deputise and support the Head of Legal, APAC.
  • Solid understanding of the laws and regulations that cover the financial services industry, including the Corporations Act and other equivalent legislation.
