Legal Officer

An exciting opportunity exists for a qualified and experienced individual with the ability to work in a small team of professionals as a Legal Officer at the Electrical Trades Union (ETU) NSW Branch (the ETU).

The ETU is a highly engaged player in the industrial relations sphere, regularly appearing in front of Commissions and Courts. We are a trade union that fights for, and defends, the rights of electrical workers and other skilled workers across a wide range of industries.

We have experienced, and continue to experience, year-on-year growth and our legal team performs work that is important to our overall services to members and long-term growth strategy.

The role

The responsibilities associated with the role include:

- advocacy before the Fair Work Commission (including PABOs, MSDs, right of entry disputes, scope orders, unfair dismissals, bargaining orders, Award reviews etc);

- advocacy before the Industrial Relations Commission of NSW (including new award applications, award review, and industrial disputes);

- advocacy and/or briefing Counsel for matters in the Federal Circuit Court and Federal Court of Australia (including breaches of the Fair Work Act);

- providing legal advice and assistance to the ETU’s leadership;

- identifying and pursuing matters of importance, including through strategic litigation;

- providing legal advice to members and organisers;

- undertaking legal research;

- working in a team and being involved in the training and mentoring of other team members.

The requirements

Essential requirements include:

- a demonstrated commitment to trade unionism or social justice;

- admitted to practice as a lawyer in Australia;

- experience as a lawyer in a union or in an employment law practice;

- an excellent understanding of the Fair Work Act and the modern award system;

- being comfortable with advocacy and public speaking;

- having a strong work ethic and time management skills.

The benefits

Working with the ETU will expose you to diverse legal work and forums in which to advocate for workers’ rights. You will be at the forefront of litigating test and novel cases in the area, and negotiating directly with peak bodies, government agencies and employer representatives to achieve outcomes for our members.

You will also get to work directly with the State Secretary, organisers and members to achieve outcomes at the industry and workplace level.

You will work with a Senior Legal Officer and the Head of Legal and Operations, and you will have access to a paralegal to assist you with your work. While you work in a team, the role comes with a high level of autonomy.

Attractive salary (approx. $150,000 per year + super) will be negotiated with the right candidate.

In addition to salary, the role attracts 19% superannuation, monthly paid RDOs, 5 weeks’ annual leave and other generous entitlements.
