The purpose of the Commercial Manager is to provide effective and efficient management through the lifecycle of a range of commercial relationships, major contracts, ongoing development of strategic business improvements, and delivering innovative commercial and procurement solutions to the business.
You will be primarily responsible for providing commercial, negotiating, risk management and contractual expertise during both the pre-contract and execution stages of Wabtec Control Systems’ tenders, projects and contracts to ensure that they are commercially successful whilst providing governance to the systems and processes to ensure compliance.
**Responsibilities**:
- Provide and present regular, clear briefings, analysis and summaries of complex legal, technical, commercial and risk-related bid and contract issues for executives and offer input into the Wabtec Bid Governance process.- Provide direction on co-ordination & review of legal, commercial and risk-related positions and compliance matters, in conjunction with the ANZ/APAC Legal Counsel (and, external advisors, where appropriate).- Be responsible for negotiation and finalisation of head contract terms and conditions and project risk parameters, consistent with bid risk profile, Wabtec Tender Policy and risk appetite and prepare and present business cases and rationale for approval to accept risk (based on appropriate mitigations) to Senior Corporate Executives.- Work closely with the project delivery teams to ensure contractual and commercial rights and obligations are clearly communicated.- Lead, manage and facilitate the development and implementation of a contract management framework and dispute avoidance strategy that aligns with Wabtec Policy and with industry best practice.- Work with project teams to manage contracts through the full contract lifecycle (including insurance, variations, extensions of time, acceleration orders, directions, amendments and disputes).- Foster and manage commercial relationships with key stakeholders, customers and projects.- Provide advice on and manage commercial matters, contract negotiations, disputes and contract risk allocation to support the achievement of best practice compliant contracts.
Qualifications and Skills- Tertiary qualifications in a field such as business, commerce, engineering, project management, law or another relevant discipline.- Demonstrated experience as a Commercial Lead with experience on Infrastructure and/or Construction projects.- An excellent understanding of contract law with experience in various procurement strategies and contract types in a large business environment, ideally working in rail and on major infrastructure projects.
Working Relationships- The Commercial Manager works closely with the WCS Managing Director, ANZ/APAC Legal Counsel, Commercial Operations Lead, Sales Managers and project delivery teams.- Maintains and fosters relationships with current and potential stakeholders, in particular, clients, service providers, contractors, subcontractors and employees.
