The Consumer Affairs Legal Team (CAV Legal) provides legal services to the Director of Consumer Affairs Victoria and initiates legal enforcement responses including initiation of court and disciplinary proceedings. On or about 1 January 2023, CAV Legal will transition into the Department of Government Services.

About the CAV Legal team and roles
The CAV Legal team provide legal services across CAV, but primarily to the Regulatory Services Division. That support is provided through the provision of specialist legal advice to investigators prior to and during the course of investigations, preparation of legal briefs and materials to assist in the successful prosecution of defendants and by appearing and conducting litigation in all jurisdictions, including the Victorian Civil and Administrative Tribunal, Magistrates' Court of Victoria, County Court of Victoria and the Supreme Court of Victoria as well as the Federal Court of Australia. The position also takes a leadership role in project teams conducting sensitive and complex investigations and other compliance and enforcement activities.

Your Role
- Provide solutions-based legal and policy advice relevant to Australian Consumer Law, both individually and through leadership and management of a of solicitors.
- Manage a caseload of complex litigation files within the civil and criminal jurisdictions.
- Appear as a solicitor advocate in complex civil, criminal and disciplinary litigation matters on behalf of the Director of Consumer Affairs Victoria (the Director).
- Deliver expertise at a statewide specialist level in high quality legal advice, particularly on sensitive and critical enforcement actions within CAV's enforcement framework.
- Support staff in legal aspects of investigations including advice and the preparation of affidavits and statutory notices.
- Provide support and advice to the Director and CAV's Compliance Committee to consider compliance outcomes.
- Support the overall conduct of enforcement actions in a dynamic environment, including coordination of legal action with other federal and state enforcement agencies

What we are looking for
For the advertised role, you will need to be legally qualified in Australia and have previous experience in the interpretation of legislation and provision of complex legal advice. Experience in appearing in courts and tribunals and managing the conduct of legal proceedings is essential.
- Demonstrated experience in prosecuting/litigating complex and sensitive criminal and civil law cases in a range of jurisdictions.
- Experience in Managing, leading and professional development of legal practitioners
- Experience managing legal work in a complex environment including liaison with investigators and other state and federal bodies.
- Experience in supporting investigations and in the preparation of and appearances in civil and criminal litigation in complex matters.
- Experience as a solicitor advocate appearing in both criminal and civil jurisdictions.
- Experience in directing legal research and demonstrated ability to develop and direct innovative responses to new and emerging issues.

Qualifications/Requirements
- Completion of a relevant law qualification and admission or eligibility for admission to practice as a barrister and solicitor in Victoria is mandatory.
