Principal Consultant - Right to Information (RTI) and Privacy

About the Role
You will undertake the role of RTI and IP decision maker and ensure LAQ satisfies its responsibilities under the Right to Information Act 2009 (Qld) (RTI Act) and Information Privacy Act 2009 (Qld) (IP Act), and other related Commonwealth and State legislation as required.
In this role, your responsibilities will include:

  • Manage, lead and administer LAQ's compliance with the IP Act and the RTI Act.
  • Process and exercise decision making power for a caseload of multiple RTI and IP applications including complex and sensitive applications with reference to relevant legislation, other jurisdictional precedent and the LAQ instrument of delegation.
  • Coordinate and evaluate requests to access LAQ's documents under LAQ's Administrative Access Policy.
  • Develop policies and procedures and provide specialist advice to leadership about RTI and IP issues, breaches and privacy complaints. Provide expert advice to all LAQ staff on investigating privacy issues and responding to privacy complaints affecting LAQ.
  • Identify privacy risks and provide guidance and advice on the impacts associated with privacy breaches. Make recommendations to senior and executive management for action and process improvement in line with the IP Act.
  • Identify the education needs of LAQ staff and develop and deliver training sessions and support material to promote compliance with information privacy and access provisions relating to RTI and IP.
  • Research, interpret and identify legislative exemptions, collate documents, prepare decision letters and explain exemption provisions in plain language.
  • Foster relationships with key internal and external privacy stakeholders, including the Office of the Information Commissioner, members of the medical and legal profession, and external agency officers to develop a compliance culture across LAQ.
  • Prepare RTI and IP reports to satisfy agency requirements and provide statistics to the Department of Justice for the RTI annual report.
  • Monitor, analyse and report as appropriate on developments in privacy law and government guidelines which impact on LAQ and update the enterprise risk management and corporate governance frameworks as required.
  • Monitor and review LAQ administrative procedures and policies affected by changes in the IP Act, RTI Act and other relevant legislation and recommend procedural improvements as required.
  • Contribute to reviewing policies and procedures, carrying out compliance audits and preparing reports.


How You Will be Assessed
The ideal applicant will be someone who has the following capabilities:

  • You have experience in applying and interpreting legislation, particularly Right to Information and Information Privacy legislation and in a customer service environment or dealing directly with members of the public.
  • You have knowledge of privacy procedures and responsibilities and have proven experience in making risk based RTI and IP decisions and have a general understanding of government agency governance functions.
  • You prepare written material in a clear, concise and articulate manner and can work independently, plan ahead and monitor task progress to meet deadlines.

Mandatory Role Requirements
This role requires comprehensive knowledge and experience of the provisions of the Right to Information Act 2009 (Qld) and the Information Privacy Act 2009 (Qld). Possession of relevant tertiary qualifications will be highly regarded.
